Uh, the debate immediately [00:26:10] opened up about whether that was too much or too little. For Kosovar society, it's [00:26:13] too much, here the comments are that it's too little. Even [00:26:17] a parallel was drawn with Banjska. I think Ms. [00:26:20] Trajković was the first, not to undermine, I don't want to [00:26:24] discredit her. [00:26:27] I don't want to mislead [00:26:31] uh her personal feelings. what's happening [00:26:34] uh in the context of Kosovo [00:26:36] and the victims, she says how is it possible that for there [00:26:40] to be life imprisonment for four dead people, and [00:26:43] here for so many dead people and and and [00:26:47] unlawfully detained tortured, only [00:26:49] 25 only 25 for people of that [00:26:53] age is actually equivalent to life imprisonment or [00:26:57] something very similar to that. Well, uh, [00:27:00] so we are here now dealing with... some symbolism, right? How much [00:27:04] that punishment reflects the severity of the act, and not actually [00:27:07] the essence, well, that comparison is very problematic. You can for [00:27:11] a simple murder, so completely without any political [00:27:15] connotations, get in some country life imprisonment or [00:27:18] 40 years for one murder, so here we are talking about [00:27:21] war crimes that are massive in nature, now you would then be able to say every war [00:27:25] criminal should get life imprisonment and end the story, but international [00:27:29] criminal courts and tribunals do not act that way, they use [00:27:32] various... ways of differentiating those punishments. In [00:27:35] this particular case, these sentences that were handed down yesterday are [00:27:39] more or less completely in line with the practice of international courts, [00:27:42] specifically in the case of Šainović et al which also dealt with Kosovo, [00:27:46] so crimes of Serbian forces in Kosovo, all the [00:27:50] accused received lesser sentences than those handed down yesterday [00:27:53] to Thaci and Krasniqi, so Šainović received 18 years, Pavković received [00:27:57] 22 years and Thaci and Krasniqi received 25. I mean, [00:28:01] that's the relevant comparison. Not what happened in Banjska where [00:28:04] the proceedings were conducted before some ordinary domestic court, not before such [00:28:08] a hybrid internationalized court. Yes, there was also a debate about [00:28:12] there being no uh uh that organ trafficking was not [00:28:16] included in the indictment, the Yellow [00:28:18] House and so on. Do you have a position on that? So [00:28:22] we know from the statements [00:28:25] uh of the investigators later [00:28:28] the prosecutor that there is [00:28:31] no evidence... uh enough to bring, that's what was [00:28:34] said, to bring charges. Do you think that's the reason or something else? That's [00:28:37] actually, I think, a very complicated question that needs to be explored [00:28:41] more deeply. So, two things, two [00:28:44] sets of crimes, let's put it that way, were not the subject [00:28:47] of this case. The first thing is that whole story about organ [00:28:51] trafficking, which actually, if you remember, was the driving force [00:28:55] for the establishment of this special court. So [00:28:58] that Dick Marty report which then provoked [00:29:02] the European Union to, along with other allies, actually impose on [00:29:06] Kosovo the establishment of this court, uh that [00:29:09] story about human organ trafficking was not [00:29:12] the subject of that case at all. Also, the subject of that case was not the ethnic [00:29:16] cleansing of Serbs from Kosovo after the war ended, [00:29:20] so after the armed conflict was over, and that was June 20, [00:29:23] 1999, then actually most of the crimes that happened [00:29:27] against Serbs were committed in that period when Serbian forces withdrew and [00:29:31] went into self-defense. "And in those few months, so, [00:29:34] about a thousand Serbs died, I mean, in Kosovo, [00:29:37] most Serbs were, were now they left then, so, [00:29:41] these acts were not the subject of this case at all, [00:29:45] but is it, is it understandable or not understandable, [00:29:50] look at it, one way which I'm afraid is dominant here [00:29:53] uh in Serbia would be the following, that the reason why this case [00:29:57] did not mention organ trafficking or the ethnic cleansing of Serbs from Kosovo after the end [00:30:01] of the war is some conspiracy. So the West and all those Western [00:30:05] judges decided to cover up everything that happened to the Serbs, that [00:30:08] is option one, that is the option I don't believe, but I am afraid that is the option that [00:30:12] I tell you will in some case become valid, that which [00:30:15] you are talking about now after the end of the war could [00:30:18] eventually, if it is raised, I assume that this court [00:30:22] will not close its doors now, but continue to work [00:30:28] investigations, that would be a crime against humanity [00:30:31] eventually. That's right, exactly and both [00:30:35] issues, i.e. organ trafficking and the ethnic cleansing of Serbs after the end [00:30:38] of the war, can be the subject of some future proceedings. We know that [00:30:42] this court has not concluded all its proceedings, so a [00:30:45] month ago the prosecutor filed a new [00:30:49] indictment, the contents of which we do not know, it is still [00:30:52] under uh uh confidential, so it is with [00:30:55] the duty judge for those preliminary questions only.
