[00:00:00] hospitals across this [00:00:01] in trip that are being able to barely function and [00:00:05] provide very basic [00:00:08] of [00:00:08] of medical medical [00:00:13] of of services, yeah services basically over there, but most hospitals have been bombed have been destroyed [00:00:17] and killed, you know people inside have been killed, and [00:00:20] a of of [00:00:21] of course these are hospitals [00:00:24] of are is part of infrastructure that is civilian [00:00:28] of infrastructure and according to international laws, again [00:00:32] of it is a war crime to uh bomb [00:00:35] hospital, but of course first of all when it [00:00:39] when it comes to the military or the regime, they of course deny [00:00:43] responsibility for it, and then when it [00:00:45] of comes to the international [00:00:47] of of organizations that have supposedly made these laws to [00:00:51] prohibiting you know these kind of actions [00:00:54] a during war and labeling them as war crimes, these [00:00:57] organizations first of all do not uh... acknowledge [00:01:01] that the crime has been committed and failed [00:01:04] to take the necessary action to stop the [00:01:08] enemy, stop the basically aggressor, and then [00:01:11] maybe later they will give out a statement to strongly [00:01:15] condemn the act that has taken place. [00:01:19] right, okay, thank you so much for that, Zainab, as we've been discussing from [00:01:23] the beginning [00:01:23] of the rolling coverage today, many analysts draw parallel between the [00:01:27] US atrocities against the indigenous people, and the violence against the [00:01:31] people of Gaza these days when I joined by a correspondent in Der [00:01:35] Balag outside al-Aksa Hospital. Let [00:01:39] us uh let me mention that the medical facility saw a shocking attack in [00:01:42] October 2024. The attack struck tents within the [00:01:46] ground [00:01:46] of the hospital. Over to you [00:01:48] Garda. Yeah, [00:01:52] first of all, let me start by reminding that after three [00:01:56] years [00:01:56] of the Israeli genocide, the [00:01:59] in genocide is still. continued is it still reaping more lives on the [00:02:02] ground and a whole year after the announcement [00:02:05] of the seasfire agreement, Palestinians here are still [00:02:09] subject [00:02:09] to an Israeli genocide that is still continuous until [00:02:13] this moment. In the past [00:02:15] of 24 hours, seven Palestinians have been killed, more others were injured, [00:02:19] around 28 have been injured in the past 24 hours. Since the [00:02:23] beginning [00:02:23] of the announcement, until now at least [00:02:26] 1,400 Palestinians have been killed. as [00:02:30] a result [00:02:30] of the Israeli attacks against the Palestinians here and [00:02:34] against the civilians in all the areas [00:02:36] of the Gaza strip, the genocide is still continuous, but [00:02:40] actually the the [00:02:42] of announcement [00:02:43] of of the tea's fire that took place back in the 9th of October 2025 has [00:02:47] diverted the attention from the Israeli massacers that are taking place [00:02:51] here in the Gaza strip, however this actually [00:02:55] is um telling that the genocide is continuous over with [00:02:58] less but... noisy pattern as you know today marks the [00:03:02] day [00:03:02] of the indigenous people and in [00:03:05] in some parts [00:03:05] of the globe, [00:03:06] some indigenous people are celebrating [00:03:08] their cultures, their traditions and their [00:03:11] existence on their land, and on the other hand we have [00:03:15] here the palestinian people being subjected to this [00:03:18] Israeli genocide, that's main goal is to wipe and [00:03:22] to [00:03:22] of ethnically cleanse the people that is existing on this [00:03:26] land, today marks a day that in which the [00:03:30] indigenous people should actually uh celebrate their [00:03:33] existence, however, as you know, palestinians are being [00:03:37] ethnically cleansed and as are being killed, [00:03:40] palestine not only in gaza, but also palestine not only in [00:03:44] gaza, but also every day since the beginning [00:03:47] of the [00:03:48] is every day since the beginning [00:03:49] of the Israeli genocide and since and even before that [00:03:53] is actually marks a day that is engraved in [00:03:57] the memory of at least one palestinian. a day of devastation, [00:04:01] a day of loss and a day of pain uh for [00:04:05] them. one of those days is today's [00:04:07] of date in which the Israel incubation army committed [00:04:11] horrific massacre here in alqsa hospitals [00:04:15] vicinity in which palestinians were actually taken shelter [00:04:19] in one [00:04:19] of the tents in the western [00:04:22] bar aqsa hospital, the israely army attack them [00:04:26] brutally, burn them alive while trying to asleep in the... [00:04:30] of since one [00:04:31] of the survivors of those massacers was um muhammed here, [00:04:34] muhammad is my [00:04:35] of guest today and she is one [00:04:38] of of of the survivors who survived this horrific attack along with her seven [00:04:42] daughters, she is actually recounting some [00:04:46] of horrible of details [00:04:47] of about the this particular massacers and about [00:04:50] in how the Israel ocupation have been repeatedly targeting [00:04:54] of civilians and targeting people inside the uh the [00:04:57] vicinity of this hospital and outside as well, muhammad [00:05:01] has went through very um, has actually gone through very [00:05:05] horrible and very horrific incident since the beginning [00:05:08] of the Israeli genocide, fleeing from the north of Gaza. [00:05:12] finding shilter here aqa hospital to [00:05:16] to actually to take refuge from the Israeli attacks and from the [00:05:20] Israeli masters that are taking place, however even in [00:05:24] this place she cannot find safety until now a short while ago she [00:05:28] was actually talking about another incident in which she [00:05:32] was um adjacent to the attack that took place [00:05:35] few [00:05:36] uh weeks [00:05:37] ago when the Israel incubation targeted the warehouse the [00:05:41] kidney dialysis. situations in which this aspect [00:05:45] was very close and very adjacent to her tent and was [00:05:49] about to post her life and her [00:05:52] daughters, so let's start by welcoming muhammad [00:05:56] with us and she is about to tell us how [00:06:00] um let us talk [00:06:03] about what this day in particular today's date [00:06:07] what that actually recals to your mind and to your memory we [00:06:11] know that this [00:08:14] ما قدرت الدفاع المدني يطلعهم انحرقوا قدام عينينا وحنا مش [00:08:18] قادرين [00:08:18] نجديدهم [00:08:27] وكمان مره بخيمه ثانيه [00:08:30] يشهد الله بنتي لليوم شاضيه في صدرها [00:08:34] يعني استشهد واحد جاري خيمه امنه [00:08:38] يعني كل الشضايا جت علينا الله جت [00:08:42] علينا [00:09:42] many these [00:09:43] memories, [00:09:48] okay, as part of our rolling coverage the indigenous people's day, [00:09:52] we discussed the US Israeli genocidal act against other [00:09:55] nations, especially the people in west Asia, we had an interview [00:09:59] with the wife the matared Iranian sailor who lost his life [00:10:03] a US attack on the denafrat in international [00:10:07] waters and now let's watch an interview with Dr. Ismail [00:10:10] Karimopor who is the director of department of international law [00:10:14] US act of aggression and with this act of [00:10:17] aggression and with this video after you watch it will be the end of our [00:10:21] ruling coverage on this ongoing uh day of [00:10:25] the occupied people in the United [00:10:28] States. [00:10:32] Welcome back, now as part of our coverage the extents and various aspects [00:10:35] the US act of aggression against the Iranian navy [00:10:39] fregate, IRIS Dena. We are now joined [00:10:43] by Dr. Ismail Karimipur, the director the department [00:10:47] of International Law the Iranian Army's Navy. [00:10:51] Doctor, thank you so much for your time today. On March the 3rd. [00:10:55] the Iranian warship Deno was targeted by two US missiles [00:10:58] in international waters, killing 104 crew [00:11:02] members and injuring another 32 uh [00:11:06] people on board. experts say that this attack given the [00:11:10] protected the status the Iranian destroyer and the [00:11:14] fact that it occurred outside the conflict zone, it [00:11:17] constitutes clear violation of international [00:11:21] humanitarian law and also the principle of neutrality. [00:12:25] be conducted based [00:12:26] on the principles of humanity and public conscience. In [00:12:30] practice, the Martin's clause serves as moral filter through [00:12:34] which all actions and decisions in wartime should pass. [00:12:38] However, when we examined the actions the United States in all [00:12:42] wars, particularly during the recent conflict involving our [00:12:45] country, including the attacks on Minab, lamberd, [00:12:49] and the destroyer, one thing is strikingly absent, [00:12:53] humanity and the conscience. [00:15:15] These are activities that promote maritime security and [00:15:19] peace. The purpose of vessel's mission and its [00:15:22] location must both be considered. [00:15:41] circumstances, attacking the vessel constituted [00:15:45] under those violation the principle of distinction. further more, article [00:15:49] 47, paragraph f the san remo manual [00:15:52] grants protection to vessels engaged in scientific, [00:15:56] humanitarian and training missions. this makes the attack [00:16:00] additional and clear violation of international humanitarian [00:16:04] law. there's another important issue for attack [00:16:07] to be... lawful, it must provide definite military [00:16:10] advantage. This is closely related to the fundamental [00:16:13] principle of military necessity. In this case, the [00:16:17] United States also violated that [00:16:20] principle: 46 the [00:16:22] article Sunro Manuel states that if vessel is [00:16:26] not making effective contribution to military operations, [00:16:30] the legality of attacking it requires specially careful [00:16:33] assessment, vessel that is not effectively participate. [00:17:20] This protection is reflected in the geneva conventions and other [00:17:24] international treaties. Article 41 of [00:17:27] additional protocol I to the Geneva Conventions [00:17:31] explicitly states that persons who are out of combat must [00:17:35] not be targeted attacks. [00:17:37] stated [00:19:20] the names of those people who were accountable for this act [00:19:24] of aggression against [00:19:25] the th warship saying that they are going in your view what [00:19:29] measures and mechanisms in your view what measures and mechanisms [00:19:33] order in international law to order in international? [00:20:07] the issue on two levels: the first level concerns the [00:20:11] international responsibility the United States and the governments [00:20:15] that supported it in carrying out attacks against Ivan, including the [00:20:19] attack on the Denner Destroyer. Under this obligations, as [00:20:23] member the United Nations, the United States has committed [00:20:27] serious violations, including violations of article 2, [00:20:30] paragraph 4 the UN charter, which explicitly [00:20:34] prohibits the use of force in relations between... [00:20:50] maintaining international peace and security, it is tasked [00:20:53] with identifying threats to peace, responding to [00:20:57] violations and preventing the continuation of war [00:21:01] crimes, crimes against humanity and other actions that [00:21:05] undermine international security. however, the political [00:21:08] structure the security council, particularly the veto [00:21:12] power granted is permanent members, including the United States [00:21:16] itself, creates significant obstacles to addressing. [00:21:26] the United States may be held responsible [00:21:28] In addition, under other principles of international law, including the draft [00:21:32] articles on responsibility of states for international [00:21:35] wrongful acts adopted in 2001. These [00:21:39] principles establish that states are responsible for their [00:21:42] internationally wrongful conduct and must be held [00:21:46] accountable for it. Article 16 of those. [00:21:50] articles, which is widely recognized as reflecting [00:21:54] customary international law, extends responsibility, [00:21:58] not only to the principal actor, but also to states [00:22:01] that help, facilitate, support or otherwise [00:22:05] contribute to unlawful acts. this means that [00:22:09] Iran may pursue legal action not only against the United [00:22:13] States, but also against governments that provide the support [00:22:17] for those actions. national judicial [00:22:21] mechanisms available, including the international court of [00:22:24] justice, the ICJ and the international criminal [00:22:27] court, the ICC. the ICJ however faces [00:22:31] jurisdictional limitations because its authority [00:22:35] generally depends on the consent of [00:22:38] states which can make pursuing such cases more difficult. [00:22:42] the second level of accountability concerns individual [00:22:46] responsibility, namely the responsibility of officials and [00:23:20] basis for bringing cases against foreign states in Iranian [00:23:24] courts. the United States itself has often relied its [00:23:27] domestic courts to pursue claims against other countries, [00:23:31] including Iran. Iran has likewise used its own legal [00:23:35] system to pursue similar cases. for example, in [00:23:38] connection with the 1988 attack on the Iranian naval [00:23:42] vessels, Sahand, sabalan, and Joshan, legal [00:23:46] proceedings were launched in recent years through the navies [00:23:54] Those proceedings resulted a court ruling holding the United [00:23:57] States liable. The case was brought by the families of [00:24:01] those who lost their lives aboard those vessels. A similar [00:24:05] legal process could be pursued by the families of those killed [00:24:09] about the dinner and by the families of other victims the [00:24:13] conflict. There are also other legal mechanisms through [00:24:16] which these claims can be pursued and rights can be. [00:24:50] atrocities including genocide. Many believe that the struggle [00:24:54] against colonialism um, which is taking place in many parts [00:24:57] the world today, and for which freedom [00:25:01] loving nations are paying very heavy price [00:25:04] for, are similar to the struggles um awaged [00:25:08] by indigenous communities over the past uh several [00:25:12] uh centuries uh by the US. um, in [00:25:16] essence, they argue that both struggles are [00:25:20] fundamentally the same, the question is, how will [00:25:23] the international institutions continue their inaction [00:25:27] in the face of all these seemingly [00:25:31] endless level of high level of [00:25:34] atrocities against the people the world? [00:25:37] ببینید در خصوص نهادهایی که نقش آفرینی [00:25:41] میتونن داشته باشن نهادهای بین المللی که برای when discussing the [00:25:45] institutions that can play a meaningful role in supporting the [00:25:49] victims of war. violence and armed conflict, there are a [00:25:52] number of international bodies that come to mind. At the forefront [00:25:56] is the United Nations Security Council, whose primary [00:26:00] responsibility is to maintain. to national peace and [00:26:03] security and to address violations that threaten global [00:26:07] stability, unfortunately, because of this unique political [00:26:11] structure and the veto power held by his permanent repeatedly [00:26:15] demonstrated this inability, repeatedly demonstrated this [00:26:18] inability to effectively respond to such crimes and acts [00:26:22] of violence. as result, it has often been unable to prevent [00:26:26] these abuses or reduce the devastating consequences of [00:26:30] war. another institution worth mention. is the international [00:26:34] committee the red cross which is responsible for promoting [00:26:37] international humanitarian law, protecting victims of armed [00:26:41] conflicts and monitoring compliance with the Geneva [00:26:44] Convention. Despite his considerable efforts in this [00:26:48] field, the International Committee the Red Cross has largely been [00:26:52] limited to an observational role, although it has [00:26:55] documented violations and recorded evidence of [00:26:59] abuses, its level of involvement has not been... [00:27:02] sufficient to stop the violence, nor has it been able to [00:27:06] adequately protect victims in the face of aggression and political [00:27:10] power. the problem is not a lack of legal rules [00:27:14] governing warfare or the law of armed conflict. the real [00:27:17] problem lies in the significant gap between the laws that [00:27:21] exist and the effective mechanisms needed to enforce [00:27:25] them, while legal frameworks and enforcement mechanisms have been [00:27:28] developed, they have often failed to ensure the implementation. [00:28:32] Thank you so much for your time today, thank you for having [00:28:36] me on your program, [00:28:38] and that brings us to the end of this edition of our interview with [00:28:42] Dr. Ismail Karimpur, the director the department of international law [00:28:46] the Iranian Army's Navy. Thank you for joining [00:28:48] us. [00:29:05] Looks like we're finally done [00:29:07] here, [00:29:18] crisis, devastating wars, [00:29:21] terrorism, the Israeli [00:29:24] lobby, [00:29:27] crackdown, [00:29:32] Diplomacy [00:29:38] us indigenous people's [00:29:40] day. [00:30:08] Headlines on Press TV, Tehran reject Washington's claim that [00:30:12] energy shipments continue freely through the street [00:30:15] of voruse, saying the US reliance and other countries for fuel [00:30:18] contradict this [00:30:19] narrative. And oil prices [00:30:23] standing two-week high. Saudi oil officials won the pressure on the [00:30:27] energy chain will continue and increase until the volmst rate is [00:30:31] reopened. A teenage boy [00:30:35] is arrested in France after shooting staff members of Ameel [00:30:38] school. Police say the incident is not linked to student protests across [00:30:42] the country.
