[00:02:00] of still right here with me, good to have you on the show, thank [00:02:04] of you sir, thank you for having me, and of course i have Raymond who is [00:02:07] of also [00:02:08] of a legal practitioner is joining us virtually, Raymond, it [00:02:12] is indeed a pleasure to have you you on [00:02:16] Zoom to [00:02:30] go, it's all right, let me take on you first [00:02:32] of quickly, now how does a law enforcement [00:02:35] of operation end with dozens of detainees [00:02:39] losing their lives from your [00:02:43] of standpoint? very very pointed question, honestly um, it's a very, [00:02:47] very unfortunate situation, um, might call it [00:02:51] case of law enforcement goon [00:02:54] of totally wrong, you know, it shouldn't this sort of, [00:02:58] this kind of story should never have happened. [00:03:02] when the news broke, the first thing that jumped at me is [00:03:05] this, under the constitution you can't detain a suspen [00:03:09] beyond [00:03:10] of 48 hours without charging them to the nearest court, now if these [00:03:14] persons have been in custody, the question is for how long have they been kept in custody, why were [00:03:18] they not ch to court, so so [00:03:20] so when you prop [00:03:21] in deeper into this into this issue, it does, [00:03:24] of it just tells you the very very dysfunctional [00:03:27] nature in which law enforcement is... conducted in this country and [00:03:31] kid you not, this is my tough, the [00:03:34] of NSCDC is not an isolation, it's the same thing happened across the [00:03:38] various law enforcement [00:03:39] you know in this in this country, and it is because this [00:03:43] one has now blown in the face, that's why it is getting this of attention, [00:03:47] a but I tell you this is the this is this is the norm across law various [00:03:51] law enforcement you their detention cells, and I [00:03:55] hope by the end of this whole incident [00:03:57] of it to perhaps [00:03:58] you know uh ' triggered necessary reforms to make sure [00:04:02] that law enforcement agencies who have the right to detain suspect [00:04:06] or detain suspect within the limitations [00:04:09] of the law, if you have suspect that for some reason [00:04:13] have health [00:04:15] of you know underline health issues is either you you charge them to court or you send them to [00:04:19] um to the nearest health facility where they could get care you [00:04:23] know the fact that a person is your custody does not make [00:04:26] them guilty [00:04:27] of the allegations brought against them they are still retain the the [00:04:31] their presumptive right of of of innocence or proving [00:04:34] guilty so it's [00:04:36] a very bad um situation and i just [00:04:39] hope uh with the interventions here and there by the president, the police, the [00:04:43] minister of interior um the those who [00:04:47] are liable consequ we should see the consequences felt either in terms of [00:04:51] persons losing their job so that the [00:04:53] of deterrant value may be felt and we can [00:04:55] you know begin to conduct law [00:04:56] of enforcement with more [00:04:58] of decents in this. Thank you very much, uh, Bon Ali, very [00:05:02] quickly, one [00:05:04] of the accounts of uh, one [00:05:06] of the survivors, we were jampacked in the cell, no ventilation for [00:05:10] us to breathe well, all of sudden. we realized that we could not [00:05:14] breathe and we're all scampering for where to have [00:05:18] fresh air. we even appealed to the several [00:05:21] you know uh to them several times bank the cell door but they [00:05:25] refused to answer us. this was an account from dawda [00:05:29] shehu. now the NSC report, NSCDC reportedly [00:05:32] attributed the death [00:05:34] to suspected disease outbreak. another independent report revealed [00:05:38] suffocation. is this not getting already intense with contradictory [00:05:42] report? and findings: well, first of all, the constitution of this [00:05:45] country, the 1999 constitution guarantees a right to [00:05:49] life, you cannot take the life of any person [00:05:52] intentionally a manner that is not sanctioned by law, [00:05:56] eg, [00:05:57] you know, execution of a court order, where someone has been pronounced [00:06:01] guilty of murder and should be executed, or in defense of [00:06:04] public property and lives when there's an insurgency, [00:06:08] breakdown of law and order and all those things that guarantee law enforcement. [00:06:12] to resist yeah a manner or when when it is a [00:06:16] situation where a capital offense is being committed [00:06:20] or you know and so the law enforcement have a duty to ensure that they [00:06:24] prevent that capital offens in that process lives may be taken [00:06:28] but these are you know places or situations [00:06:31] where uh the law you know gives some kind of [00:06:35] backing for that type of activity so in this situation [00:06:39] 33 people is huge number of Nigerians who [00:06:43] should have been presumed innocent until proven guilty yeah, [00:06:46] so they were a room a survivor [00:06:49] says they were [00:06:52] suffocated, but obviously they [00:06:55] died without um um any [00:06:59] legal basis for them dying in the way that they died and [00:07:03] as such a probe into their deaths is the [00:07:06] least that the authorities you know should ensure be [00:07:09] done obviously one the you most effective [00:07:13] ways of proving uh cause of death is an autopsy, the right? [00:07:17] all 33 bodies [00:07:20] should be uh, you should be should should be examined [00:07:23] by pathologist who will determine the cause of death, [00:07:27] if it is suffocation, if it is poisoning, whether [00:07:31] food or drink or any form of uh, perhaps even [00:07:35] gas introduced into the cell, because the subject matter the [00:07:39] alleged crime is so controversial. that [00:07:43] you cannot remove the fact that a crime may have been committed, [00:07:47] which led to the death these 33 people, 37, 37 people, [00:07:51] so it it behoves on the authorities to ensure [00:07:54] that those who should be presumed innocent or to proven [00:07:57] guilty, who lost their lives in the custody of constituted [00:08:01] authority, there must be answer [00:08:05] to how and why they died. right, Raymond, quickly, [00:08:09] can an internal security agency investigation [00:08:12] uncover the truth when the agency itself held [00:08:16] the [00:08:17] deceased, [00:08:21] i don't think i don't think that should be the standard, this must [00:08:24] be um any genuine investigation into [00:08:28] what happened must be [00:08:30] by totally independent body [00:08:34] body so that is around [00:08:36] of course you cannot be a judge in your own cause you cannot be [00:08:39] accused. so [00:08:43] investigate to what happened, so for you how to get the confidence, the public confidence in [00:08:47] the outcome, you know, [00:08:48] it is, [00:08:49] it is, [00:08:49] it is more ideal for an independent [00:08:53] body to conduct and you make necessary [00:08:56] recommendation. all right, quickly, uh, I [00:09:00] understand that this is really getting out of hand, do you suspect any f [00:09:03] play, only a proper medical [00:09:06] evaluation, [00:09:07] you know, a forensic pathologic [00:09:11] examination will... mean the cause of death because medical [00:09:14] science is uh so advanced that that is the only conclusive [00:09:18] way of proving whether there was a cover, maybe you [00:09:22] can allude to some form of [00:09:25] high negligence, because if people are [00:09:29] complaining of lack of you know uh oxygen [00:09:32] or that they are being suffocated, and the people [00:09:36] who are keeping them in custody are not responding, it's a high [00:09:40] degree of negligence which may... rise to the point of a [00:09:44] criminal uh, criminal act. now, I must take [00:09:48] you up on this quickly, what immediate reforms uh, are necessary [00:09:52] to ensure that enforcement operations protect [00:09:55] Nigeria's mineral resources without putting the lives and [00:09:59] dignity of citizens at risk? first of [00:10:03] all, the resources [00:10:06] the people of this country [00:10:10] should be in the hands the communities. [00:10:13] that have those god given resources in their [00:10:16] areas, making mineral [00:10:19] resources item for the exclusive legislative [00:10:23] list making the federal government, the soul authority [00:10:27] on the gold in my ancestral [00:10:30] land, the oil at my backyard, [00:10:34] the diamond [00:10:35] you know under the tree in my orchard, you know smacks of [00:10:39] injustice because when the resources are actually [00:10:42] you know explored, the benefit to the [00:10:46] people where the resources are obtained [00:10:49] you know is very minimal, okay also the [00:10:53] scramble in this poverty [00:10:57] the indigens of area who have [00:11:00] no adequate or substantial interest [00:11:03] in what is within their locality leads to this kind of [00:11:07] situation so that we need to move [00:11:11] away from the centralized system of [00:11:14] exploitation and exploration of resources and make [00:11:18] those in whose backyard these resources are [00:11:21] found stakeholders and beneficiaries of this. President Bolatinu has welcomed Nigeria's [00:11:36] victory over Sunrise power and transmission company at the [00:11:39] International Chamber of Commerce Arbitration Tribunal in Paris. The [00:11:43] tribunal rejected Sunrise Power's claims and order the company to [00:11:47] reimburs Nigeria about 11.8 million dollars in legal [00:11:51] cost. The president commended Nigeria's legal team for defending. [00:11:55] the country's interest uh bly quickly we [00:11:58] unders with this surprise uh you know [00:12:02] outcome uh the president says the ruling removes the biggest legal [00:12:06] obstacle to the mambela hydroelectric power [00:12:09] project uh so what happens next? what happens next [00:12:13] is that this ruling clears the way for Nigeria [00:12:17] to properly superintend and take care of his interest in that [00:12:21] project, the legal technicalities, the contractual technical... [00:12:25] by this ruling have been done away with, so the federal government can [00:12:29] decide to engage another contractor, [00:12:33] can can decide to be a stakeholder in contributing [00:12:36] financially to the project or and not be [00:12:40] burdened with the legal [00:12:43] implication of deal or contract [00:12:47] gone wrong, so with this ruling [00:12:50] Nigeria has a free hand to move forward with [00:12:54] that. All right, Raymond, quickly, I know this is your territory, [00:12:58] yeah, now the tribunal rejected [00:13:02] uh uh Sunrises claim for 400 million and ordered it to [00:13:06] reimburse Nigeria about 11.8 million illegal [00:13:09] fees. What does this tell us about uh the strength of [00:13:12] Nigeria's defense before the [00:13:14] ICC? [00:13:18] Well, [00:13:19] without a doubt, [00:13:20] it speaks to um the quality of legal representation [00:13:24] that this action. uh receive from the Nigerian legal [00:13:27] perspective, even though I have not seen the um the [00:13:31] the award, what you've heard from news report, it appears [00:13:35] uh one the arbitrators even inducted the former [00:13:39] minister or [00:13:41] justice Malami S, [00:13:44] and I think he was found to have a man of speaking played from [00:13:48] both sides of the court and even even and almost even you know [00:13:52] um taking sides against Nigeria. [00:13:56] but to the extent that this whole process came to fion under [00:13:59] the comments [00:14:03] general very very very very [00:14:07] distinguish, [00:14:12] it's not totally surprising [00:14:14] that around, [00:14:17] so it's a big win for a big way for Nigeria, [00:14:20] and heard my friend the studio saying per the [00:14:24] government appoint another contractor, actually there is a waiting [00:14:28] contractor on the project already, there is a [00:14:31] Chinese, the Chinese exam bank already had the financing [00:14:35] to to proceed before this proceedings, stored that [00:14:38] process, so with this legal out the way [00:14:41] expect the the the project to come on [00:14:45] full stream and it has the prospect of adding 3,896 [00:14:49] megaw to the national grade, [00:14:51] it's a big is very very big project so consequential to Nigerias a [00:15:02] how much responsibility should be attached to the officials and [00:15:06] processes that allow the mambialla dispute to drag on for more than two [00:15:10] decades? Unfortunately, legal [00:15:13] issues, exhaust what you call the due [00:15:16] process, I'm not saying that [00:15:20] the length or extent to which it has dragged is [00:15:24] legally justified. bible, but in ensuring that [00:15:28] justice is done, all the parties that are involved in the [00:15:31] dispute would have been given ample time, and technicalities [00:15:35] would have been overcome to ensure. that when a final ruling [00:15:38] comes uh you know it is actually final and [00:15:42] there will be no recourse to any other interlocutory [00:15:46] proceedings and the finality the proceedings will be guaranteed [00:15:50] so I'm sure that as matter of due [00:15:53] process uh evidence was received uh [00:15:57] arguments were conversed uh witnesses were brought [00:16:00] in uh documents were tendered and you know [00:16:04] it's cross administration type of [00:16:07] dispute which started with one administration, moved into another [00:16:11] one and eventually into this administration, so [00:16:14] cooperation of all the officials in the relevant [00:16:18] ministries, including ministry of justice, those in the power [00:16:21] sector, the engineers, lot went into it, I [00:16:25] expect, and I'm sure that's the reason why [00:16:28] you know it took a lot of time, and and I think without any [00:16:32] any fear of any further [00:16:36] litigation, this should be... or put an end [00:16:38] to uh to to the whole saga. All right, Raymond, [00:16:42] quickly, now the perhaps the biggest question now here is after winning the [00:16:46] application, can the federal government turn the mambialla [00:16:49] victory into actual electricity for Nigerians from your [00:16:53] standpoint? Yeah, absolutely, and like I was saying [00:16:57] before I had the audio issues, I had [00:16:59] said, the before this matter went for arbitration [00:17:03] effectively, the the contract had been awarded to different [00:17:06] Chinese. company and in fact the chinese [00:17:10] export import bank had a 85% [00:17:14] financing on the project, but due to this dispute, they could not [00:17:18] proceed pending the outcome, so with this litigation out the [00:17:22] way, what is expected is that the necessary financing from [00:17:26] the Chinese exam bank will [00:17:27] be brought to bear, the project had the prospect of adding [00:17:31] 3,896 megw to the national grade, so it is [00:17:35] very, very consequential to Nigeria's economy. and we hope [00:17:39] that in the weeks and months and years ahead the project will come on [00:17:42] stream and the prospects the the [00:17:46] mandilla hydropilot project will come to fusion. all right, thank you very much. well let's [00:17:50] go a quick break and of course news we continues shortly. stay [00:17:53] tuned. "the president is master [00:21:51] strategist who can read the top game [00:21:55] and the bottom game. all right, Raymond, quickly now, uh, [00:21:58] wik has argued that a governor's political influence should [00:22:02] ultimately be measured by the votes delivered to the president. now do [00:22:06] APC governors have different definition of political loyalty [00:22:09] from your standpoint [00:22:10] quickly? I don't think they [00:22:14] have different uh definition of political loyalty, I think is [00:22:18] just, I think it's just the..." G3 about the week [00:22:22] factor, [00:22:24] how he he can op times, but I have to be very, very clear, [00:22:28] minister Wiki has not asked anybody to campaign against any APC [00:22:32] candidate at the state level, if he had done that, if you had shown [00:22:35] tendencis in that regard, then the fears the or the consents the [00:22:39] the progressive governors might be justified, he remains very [00:22:43] very unequivocal that he's committed to the [00:22:46] returning Mr. President, so that he can continue to retain his seat. the minister [00:22:50] the federal capital territory, so again, I think is just as someone [00:22:54] described it, it's just two legs of one body, one leg is [00:22:58] the progressive governor and the [00:23:00] APC, why the other leg are the [00:23:03] les the coalition or any other person who Mr. Wink is able to [00:23:07] governize towards delivering Mr. President at, so [00:23:21] could this dispute become a bigger problem for the APC if [00:23:24] politicians begin supporting to [00:23:26] at the presidential level, but back in different parties below the [00:23:30] presidential ballot? it could be a problem, okay, it could be [00:23:33] very, very serious problem, but I don't see the [00:23:37] problem being allowed to fester for too long, long, okay, I [00:23:41] think that once the the mandate the president is [00:23:45] secured, the necessary adjustment and [00:23:48] amendments to... will campaign structure will [00:23:51] follow, and so [00:23:53] that will mitigate any tendency for any harm [00:23:56] coming to the other elections. All right, Raymond, I'm not trying to put you on the sport [00:24:00] here, but uh, your final take on this, is the rainbow coalision [00:24:04] becoming an alternative political structure, or is it [00:24:07] simply a network of politicians united by [00:24:11] support for president Bolatinoubu? You could have [00:24:15] put it any better, absolutely the latter, [00:24:18] absolutely. self life is by [00:24:22] the e by the by the by by the end the presidential election is [00:24:25] chef life will come to an [00:24:26] end [00:24:31] all right then it appears we just have to go but bola before i go [00:24:35] quickly um it's looking quite dicey from your point [00:24:39] of view with way you have actually assessed the situation that there's a possibility that [00:24:43] the APC governors have certain fears because is it that the [00:24:46] stature the personality of wiki is? problem [00:24:50] now or the party itself that he's forming, [00:24:54] the coalition that he's coming up with, is it the coalition or the [00:24:58] personality is that they have a problem with? the suspicion of his real [00:25:02] intention is the problem, i think that he is a [00:25:05] consumate politician and understands the game, understands the [00:25:09] game and has been effective in working for the [00:25:12] president's mandate and delivering [00:25:16] uh to the president what he has promised to deliver he is. a [00:25:20] PDP party man with one leg in the PDP and one [00:25:24] leg in the APC, okay?
