What of all these promises [00:31:53] has been fulfilled? There is one point [00:31:57] that President Karol Nawrocki fully managed [00:32:01] to implement, and that is supporting farmers [00:32:04] and caring for the Polish countryside, as [00:32:07] stated in his program, because this concerns a [00:32:10] project signed in March this year. Firstly, [00:32:14] it concerns extending the ban on selling [00:32:17] Polish land to foreigners by 10 years. Secondly, [00:32:21] support for farmers in connection [00:32:23] with the European Union [00:32:30] signing a trade agreement with Mercosur countries. As you can see, even the prosecutorial and judicial proceedings indicate that it was at least illegal, but for everyone who is familiar with the activities of non-governmental organizations, including associations and foundations, they know that they can spend funds in accordance with their statutory purpose, and the aforementioned foundation was not intended to refer to any elements of the judiciary in Poland, but to promote Poland abroad. Here, it is clear as day that it was the use of public money, because that is how the foundation was financed, public money to discredit Polish judges and attack them, it is very good that this has consequences, I will even say a little maliciously, because as I recall, during the time of Law and Justice, regulations were introduced enabling the securing of assets or freezing the account of a suspect. Therefore, one would like to say, whoever lives by the sword, may not die by the sword, but is secured, this is also an important element, because incidentally, when it comes to whether Mr. Świrski was guilty or not, as citizens we should expect the possibility of recovering these funds, and why not from the assets of the person who committed a potential crime, i.e. the decision of the prosecutor's office is rather justified and shows that the matter is being taken seriously, well, first of all, the decision was made in accordance with the law, I repeat, adopted in the previous term, i.e. when Law and Justice had a majority and was in government. The prosecutor's office had every right to secure funds for the purpose of these proceedings, and it's very good that this happened. Not too late? Whether it's too late is, of course, a matter of the prosecutor's office's work, but it seems that in these proceedings, too, the formula, which will probably also be reflected in court, is being carefully applied so that it is not. I will ask, because this means [00:50:42] that the prosecutor's office has strong grounds for such an [00:50:46] action, or am I going in the wrong [00:50:48] direction? In a very good one, Mr. Editor, are you going in the right direction? [00:50:52] If the prosecutor uses this solution, which is provided for in the code [00:50:56] of criminal procedure, it means that he believes that the conditions have been met [00:51:00] allowing for the application of so-called financial security, which is de [00:51:03] facto security for the possibility of executing a future ruling [00:51:07] that will involve financial consequences for Mr. [00:51:11] Świrski. Please also remember that when the prosecutor uses this solution, he [00:51:15] expects that it will be appealed to the court, and therefore [00:51:18] he must assume that the conditions [00:51:21] are met. And that this decision in the form of [00:51:25] asset protection will be upheld in court, so, as it were, [00:51:29] answering your question again, you are leading the argument [00:51:33] in the right direction regarding the justification, the situation [00:51:36] of the prosecutor's office in relation to this specific proceeding, I will [00:51:39] repeat once again, this is a normal, standard procedure, this is how [00:51:43] the Polish state should act, when it becomes necessary [00:51:47] to secure financial interests in the [00:51:50] context of a future ruling that may... be issued, well, the Polish [00:51:53] state must be effective, court judgments, if they are issued in the [00:51:57] future, must also be executable, it is not about [00:52:00] it being only illusory justice. Well, [00:57:30] it depends on how you approach such a [00:57:34] question, because of course malcontents and people [00:57:37] who expect the state to [00:57:40] act efficiently, quickly, effectively, to [00:57:44] put all other matters aside and deal with accountability, [00:57:48] may feel a certain kind of irritation, anxiety, that this is [00:57:52] only happening three years after the coalition took power [00:57:55] on October 15th, even though the matters [00:57:58] we are discussing today, which are related [00:58:02] to the Polish National Foundation, have been [00:58:05] well known for many, many years, [00:58:09] however, I would also put forward the thesis that [00:58:13] part of public opinion prefers [00:58:17] the prosecutor's office to act independently, at its own pace [00:58:20] and that these [00:58:23] indictments that are being prepared, these [00:58:26] actions of the prosecutor's office that are being taken, these [00:58:29] decisions that we are witnessing today, were [00:58:32] prepared meticulously and reliably, but there [00:58:35] is also a third aspect that we must remember, recently one of the very [00:58:39] important [00:58:39] ministers, [00:58:44] yes Ark, we hear you, or no, we hear you. [00:58:50] There is still one element that one of the very important ministers told me about recently, [00:58:53] who convinced Waldemar Żurek, and [00:58:57] earlier Adam Bodnar, to choose 10 [00:59:00] cases related to the activities [00:59:04] of the previous government and that as the Prosecutor General, who has [00:59:07] the right to do so, he should personally supervise these cases, then [00:59:11] we would be dealing with [00:59:14] an acceleration of accountability for Law and Justice. This [00:59:57] organization was primarily intended to promote [01:00:00] Poland abroad, to promote the Polish brand abroad, [01:00:04] what Poland [01:00:07] could boast of then, [01:00:10] investments, an open market, tourism, [01:00:14] how Poland... was [01:00:18] developing, quickly, however, it turned out that this [01:00:21] foundation carried out political orders of Law [01:00:25] and Justice, especially at the moment [01:00:28] when it carried out a slanderous [01:00:32] judges, slanderous judges [01:00:35] PR campaign, [01:00:38] well, it was inconsistent with [01:00:42] the assumptions that lay at the basis of the establishment of this [01:00:45] foundation, interestingly, this foundation... still exists today, it cannot [01:00:49] be liquidated without legislative [01:00:51] changes, [01:00:54] its current bosses have repeatedly said what the money was [01:00:57] spent on, what it was really wasted [01:01:01] on, because Poland's reputation during [01:01:04] 8 years of Law and Justice rule, thanks to the activities [01:01:08] of the Polish National Foundation, did not improve, on the [01:01:11] contrary, it worsened, because the bad [01:01:14] reputation of Poland was due to the previous government, which... destroyed [01:01:18] the rule of law, the justice system, freedom, media, and so [01:01:21] on, and no PR activities of the foundation [01:01:24] could change this disastrous image of Poland [01:01:27] on the international arena. Meanwhile, on billboards [01:02:49] we could read: drunk judge causing trouble in a club, judge and wife [01:02:52] stealing electronics, judge stealing trousers, judge can lie [01:02:56] with impunity. So what was it? This promotion [01:03:00] of justice reform, [01:03:04] the slogan that this money was spent on promoting the reform [01:03:07] of the justice system, is of course [01:03:10] a political sham, a falsehood, a lie and hypocrisy, [01:03:14] because it had nothing to do with the reform [01:03:17] of the justice system, what goals and interests [01:03:20] PiS was pursuing at that time was at war with judges, so [01:03:24] it had to present the other side [01:03:27] as bad, dangerous, [01:03:31] involved in various things that look bad, [01:03:35] from trousers in a shop to [01:03:38] a brawl, well that's what the Polish National [01:03:42] Foundation did, the government could not finance it, because it couldn't [01:03:45] be attributed to anything, but there was one such person, his [01:03:49] name was Maciej Świrski, who decided to take it [01:03:53] upon himself, without looking at the consequences, and today he has [01:03:56] to face those consequences. [01:04:00] Half a million zlotys in losses, that's how much the Polish National [01:04:03] Foundation, from 17 State Treasury companies, spent [01:04:06] and allocated to these campaigns [01:04:09] inconsistently with the foundation's statute [01:04:12] of activity. Was it a natural move by the prosecution that [01:04:16] the assets of the former head of this foundation were secured? [01:04:20] When the prosecutor uses such a solution as [01:04:24] asset protection, when there is a very high [01:04:26] probability that the convicted person... in this [01:04:30] case Maciej Świrski, chairman of the board of the Polish Foundation, member [01:04:34] of the authorities of the Polish National Foundation, [01:04:36] may be obliged by a court decision [01:04:40] to repair the damage caused, the damage was [01:04:43] financial damage, so that Maciej [01:04:47] Świrski could fulfill this, [01:04:49] the prosecutor decided to secure his assets, also [01:04:53] guided by the fact that Maciej Świrski, [01:04:57] money does not stick to him, we remember. He spent [01:05:01] half a million zlotys from his company card on luxury [01:05:04] restaurants and the best hotels, so it is worth securing [01:05:07] these assets so that they do not vanish [01:05:11] when there is a court decision to cover these [01:05:14] losses caused by Maciej Świrski, so that there is something [01:05:18] to cover those losses with.
