00:09:12An upper area court in Jalingo, the taraba state capital has ordered the
00:09:16arrest of social media activist Mr. Abdul Momin
00:09:19Imam, over allegations that relief materials worth
00:09:2345 million naire meant for internally displaced
00:09:26persons, were diverted to Kanu State. The state
00:09:30government accuses him of defamation and character assassination
00:09:34while the court orders the execution the bench warrant following his
00:09:38failure to appear for trial after being released on
00:09:41bail. Council to the defendant, Mr.
00:09:44Isa Buba challenges the court's jurisdiction and
00:09:47considers an
00:09:48appeal.
00:09:52It the ruling the court is simple, they were asking the court
00:09:56to stay the warrant of arrents, warrans of
00:10:00arrents pending the hearing and the determination the
00:10:03preliminary objection and the court rule
00:10:07that filing a preliminary
00:10:10objection is not a around while
00:10:14court should stay at warrant of execution and the
00:10:18defendant has failed to convince the court with
00:10:21persuasive convincing reasons.
00:10:25while and reasons that has to do with exceptional circumstance
00:10:29while this warrant should be stated and the court has refused this application and dismiss
00:10:32it completely. the law is well established
00:10:36that once notice of preliminary objection is
00:10:39filed, the only thing the court
00:10:43should do is to exert his
00:10:46energy in hearing that preliminary objection to
00:10:50determine whether it has jurisdiction or not, and the
00:10:54court cannot... make any step further except the hearing
00:10:58the preliminary objection, but the ruling is
00:11:01highly surprising to us, but definitely
00:11:05we are going to study the ruling more after collection
00:11:09the certified true record of same to
00:11:11see the need to appeal the
00:11:15the ruling by the grace of
00:11:16God.
