01:31:32Venezuelan Association of Tax Law during all this time and all the
01:31:35academic and scientific contributions that we have
01:31:39been collecting throughout these years will be of great
01:31:43benefit for
01:31:46this moment where the tax burden
01:31:48is one of the most important challenges
01:31:52our republic faces. Precisely, I understand that you
01:31:56presented the superintendent with a system called MODA,
01:32:00if I'm not mistaken, it's the acronym
01:32:02that, in summary, has to do with modernization,
01:32:06digitalization. What does this system consist of? Because I think
01:32:10it was one of the requests you frequently made, to digitalize the
01:32:13process. Without a doubt, yes. We are in the 21st century and we cannot
01:32:17have 19th-century processes
01:32:20nor 19th-century taxes.
01:32:23In that sense, the Venezuelan
01:32:26Tax Law Association has been very
01:32:29tenacious in always
01:32:33that situation.
01:32:36In Venezuela, the tax burden is not only measured
01:32:40by the overwhelming
01:32:43amount of money that merchants
01:32:46and taxpayers have to pay
01:32:49for each profit they obtain. We have determined
01:32:53that approximately
01:32:5680% on average, of course, of gross
01:32:59income goes to pay taxes here in Venezuela.
01:33:03That gives you a magnitude, but
01:33:07also another way the fiscal pressure
01:33:09is in the tax processes. In
01:33:12Venezuela, a special average taxpayer
01:33:16also has to do more than 200 tax
01:33:19procedures per year. That means
01:33:22that if the year has 200 working days,
01:33:25they practically have to do one or more, and if, for example,
01:33:29this taxpayer has headquarters in
01:33:33different municipalities, this multiplies.
01:33:36With technology, obviously,
01:33:38it can
01:33:41be achieved that the transaction costs, the
01:33:45costs of complying with those
01:33:48tax procedures, are lowered, but that's not enough.
01:33:52It's enough, it's not enough that it's much
01:33:55easier to pay our taxes, that's undoubtedly
01:33:59a desideratum and and and we said it is so,
01:34:03but it's not enough that the great number of procedures we have to do
01:34:08what really, and I think the
01:34:11superintendence and the
01:34:15Seniat should focus
01:34:17on is to rationalize for real what are the
01:34:21taxes that should be in force and what are the taxes
01:34:25that should be paid here in
01:34:27Venezuela. Other issues were addressed there, such
01:34:31as the tax on large financial transactions, which is another
01:34:34issue that has always been on the table. No, precisely in that
01:34:38meeting the issue of the tax on financial
01:34:41transactions was addressed, but when I told
01:34:46you that we are in the 21st century and we have taxes from past centuries,
01:34:50the tax on large financial transactions is a
01:34:53tax from the mid-20th century, it is a
01:34:57war tax that is completely regressive and
01:35:01also generates distorting
01:35:04effects on the economy, as you
01:35:07know, the IGTF is paid at each
01:35:10stage of the chain, if the importer sells to the distributor,
01:35:14they pay. If the distributor pays
01:35:16the, sells to the wholesaler, they pay the
01:35:19IGTF. The wholesaler, the retailer pays the IGTF
01:35:23and the final consumer, and that 3% accumulates,
01:35:26it pyramids in the chain. What does
01:35:30that generate? Inflation. What
01:35:33formation of prices. And also, we
01:35:37believe that the IGTF has already fulfilled its mission. It was
01:35:41created at a time of extremely high
01:35:45economic activity, and today I believe we are not in the same
01:35:48situation. For what that tax collects,
01:35:51it distorts more than
01:35:55also, today the tax on large financial
01:35:57transactions is only for individual
01:36:01transactions, in a moment where Venezuela is
01:36:04calling for investors to bring their
01:36:07currencies. We find this
01:36:10tax incompatible, not only because it is distorting,
01:36:14not only because it has already fulfilled its function, but also because
01:36:18it discourages the use of currencies in a country where we are calling for

01:36:58a laboratory,
01:37:01an unhappy
01:37:05one, of how the tax burden can diminish
01:37:08economic growth opportunities. I was telling you that
01:37:11there is a tax burden
01:37:15that is very high from a material point of view,
01:37:19on average 80% of your
01:37:22income goes to pay taxes, not
01:37:26only a formal burden, which we also talked about, that you have to do
01:37:29practically every day of the year a tax
01:37:32procedure, but to that burden we also have
01:37:36to add the extremely high pressure
01:37:40that exists in inspections. In Venezuela,
01:37:44the powers of inspection and the discretionary
01:37:47powers that tax administrations have were
01:37:50exacerbated in the organic tax code and were
01:37:55discretion. This also forms part of the
01:37:58burden that taxpayers have.
01:38:02Imagine not only allocating 80% of your income to
01:38:05pay taxes, allocating a significant administrative burden
01:38:08which are also transaction
01:38:11costs to pay this
01:38:14large amount of taxes and also having to attend
01:38:18inspections by the national power in more than six
01:38:25the parafiscal administrations regarding the payroll, of the state
01:38:29administrations and the municipal administrations, but
01:38:32also there are taxpayers
01:38:35who are in special sectors such as banking,
01:38:38insurance, hydrocarbons,
01:38:42telecommunications who
01:38:45have an additional special taxation. So when
01:38:48we talk about tax burden,
01:38:52is paid every day when
01:38:56you make your tax procedures,
01:38:59but also these aspects, and finally one that
01:39:03is economic. Venezuela, for
01:39:07whatever reason, has gone through the most important economic crisis
01:39:10in Latin America in the 21st century.
01:39:13This has resulted in economic
01:39:16indices being totally distorted in reality,
01:39:19and that is why, for example, the currency, the
01:39:22Bolívar, is said to have lost its properties as a medium of
01:39:26exchange, a unit of account, a store of
01:39:29value, and that has some effects when it comes to
01:39:32determining your true economic capacity.
01:39:35It often distorts a lot. You see an accounting where you see
01:39:39that there are apparently some gains, but those gains,
01:39:43being distorted by a Bolívar that does not reflect, so to speak, a
01:39:47reality, a real purchasing power,
01:39:50then you end up determining

01:44:25cost is imposed on those who are
01:44:28registered, who do invoice, who are
01:44:32visible to the tax administration and who are
01:44:36also highly monitored. I agree
01:44:40that it is necessary to create the necessary
01:44:43conditions so that all merchants, so that all
01:44:47entrepreneurs can be registered and all contribute to public
01:44:51burdens. Now, also, apart from
01:44:54these taxes, this tax burden, could it
01:44:58be feasible to propose to know where
01:45:01these resources are allocated, where these taxes that are
01:45:05paid go? Undoubtedly yes, the
01:45:08tax issue not only implies collection,
01:45:11but also implies the management of resources.
01:45:14The fact of having a national
01:45:18budget and having transparency
01:45:21rules that are even in the constitution,
01:45:24to know what the use and destination of each
01:45:28of the items that make up
01:45:31the national budget is a right that
01:45:34all citizens have and of course
01:45:38it also results
01:45:40in collection. If you know that
01:45:44the resources you are paying are adequately
01:45:48used, you feel incentivized
01:45:51to pay these taxes
01:45:54adequately. So this works like a two-way
01:45:57street, of course it does, the tax system,
01:46:01also, I insist, should not only be
01:46:04seen in terms of collection, it must be framed
01:46:07within a whole the conglomerate of fiscal
01:46:13economic policy, uh, there cannot be a
01:46:17correct economic policy if there is not an adequate fiscal
01:46:20policy, and if there is not an adequate fiscal
01:46:23policy, we will definitely not be able
01:46:27to have incentives for economic development
01:46:31and incentives so that ultimately taxes are used
01:46:34for the welfare of all citizens. Now, another issue that I have also seen,
01:46:37uh, that you have insisted on
01:46:40is the extension of the VAT payment
01:46:43cycle, for example, also the issue of special
01:46:47taxes, the case of pensions, uh, how
01:46:50all this is handled and what prospects there are with
01:46:53this new leadership of SENIAT. Excellent
01:46:56question, uh, from the Venezuelan Association of Tax Law, we have been
01:47:00sending for a very long time, but especially
01:47:04throughout this year, some
01:47:07proposals that are measures
01:47:11that are easy to take, that do not
01:47:14require a legal reform, that do not
01:47:17require a discussion in the National
01:47:19Assembly, that can be taken very
01:47:22quickly and that have a highly
01:47:28the economy and even on collection, and you have hit
01:47:31the nail on the head in your question. First
01:47:34of all, what we have detected is
01:47:37that there is no greater investment by private
01:47:40individuals, there is no better remuneration in the
01:47:44payment of wages and salaries, because the way in which
01:47:47the collection of taxes is currently established
01:47:50is linked
01:47:53the cash flow of taxpayers. If
01:47:57we lighten the cash flow of taxpayers
01:48:01by changing declarations from every 15
01:48:04days to 30 days,
01:48:06reducing the retention rate of the
01:48:10value added tax from 75% to perhaps
01:48:1425%,
01:48:16eliminating
01:48:18some advance income tax payments that
01:48:22we have to pay every 15 days and that are also
01:48:25calculated on gross income, remember when I
01:48:29told you about 19th century taxes, in the 19th
01:48:31century it was very, very difficult to determine the income of each
01:48:35merchant. So taxes were
01:48:37established on gross
01:48:40income. Today, in the 21st century, it is not necessary, all the
01:48:43technology exists and we celebrate
01:48:46that the superintendent's
01:48:50vision is towards that, but I insist, there are measures like the
01:48:53ones I just mentioned that are very easy to take,
01:48:57eliminate income tax advances and
01:49:00pass them to the
01:49:03the law, that exists in the income tax law,
01:49:07eliminate the 75% retention
01:49:10and pass it to 25% and also
01:49:13have monthly periods as is normal,
01:49:16there are even jurisdictions where VAT
01:49:19is paid bimonthly.
01:49:22That is, every two months, understanding that the
01:49:26dynamics of collection and
01:49:29credits that exist between merchants are very
01:49:33dissimilar and different. So, taking these three
01:49:36measures, uh, let's say, the
01:49:39cash flow of taxpayers would be greatly
01:49:43relieved and we are sure, with scientific evidence, that
01:49:46this cash flow would definitely go
01:49:49to invest more and this investment
01:49:53generates economic growth and this economic growth
01:49:56generates greater collection in all existing
01:50:00taxes. Also, if you allow me,
01:50:03taxes that were shown to be completely
01:50:06superfluous in Venezuela, superfluous in the
01:50:10economic dynamic and of the Venezuelan market, and how
01:50:14was it shown? It was shown in the hydrocarbon law and in the
01:50:17new reform of the hydrocarbon law and in the new mining law.
01:50:21There we find a list of taxes
01:50:25that are exempt for both mining activity and hydrocarbon
01:50:28activity that we consider superfluous in the Venezuelan
01:50:31economy. One of them is the tax on large
01:50:35fortunes. The second of them is the
01:50:38pension tax, having a 9%. We have
01:50:42even talked about this in this
01:50:45program. Paying salaries
01:50:49and bonuses makes it more
01:50:52expensive for the employer to increase wages and
01:50:55salaries. Eliminating that para-fiscal
01:50:58taxation that is as unpleasant as the
01:51:02tax, uh, the tax established in the science and
01:51:06technology law that taxes gross income, it doesn't ask you if you won
01:51:09or lost, if you had a gain or if you had a
01:51:13terrible loss and
01:51:16you still have to pay that tax and two additional
01:51:20para-fiscal taxes that are like in the sports law and the drug
01:51:23law. The hydrocarbon law and the
01:51:26mining law already gave us the answer, those taxes are
01:51:30superfluous. Also, to ask you, if
01:51:34you comment that to make these changes you don't need a law, you don't
01:51:37need to go to parliament, perhaps, why aren't
01:51:41they taken? Is there really fear, a risk from the state to make these
01:51:45decisions, being sincere about this decision,
01:51:48also taking the opportunity to ask you about the first public
01:51:52and perhaps more communicative decision that the superintendent made, which was
01:51:56this situation of not fining businesses, as far as I understand, for not
01:51:59displaying their printed RIF.
01:52:03Uh, this implies that there is a new disposition in SENIAT.
01:52:06We see it that way, we see that
01:52:10there is a good disposition to change things
01:52:14that were irrational and can be
01:52:16changed very easily. Having a tax billboard
01:52:20that
01:52:22also takes up unnecessary space, that you have
01:52:26to keep printing on paper,
01:52:29also, with the ecological damage that this can mean,
01:52:32but the irrationality of
01:52:35having to display documents that
01:52:38are in the possession of each of the tax administrations, in our
01:52:42opinion, this was irrational and a
01:52:45decision was made that, as I insist, was very
01:52:49easy to undertake and was undertaken now.
