00:00:33after that agreement comes to light is that it doesn't
00:00:37give Iran control over the straight of hermooz, but it gives it some
00:00:41kind of control over allowing ships
00:00:45of to transit through the Iranian
00:00:48waterways so that there will be time to
00:00:52of clear the waterway in
00:00:53of between of Oman and Iran from the mines which the IRGC has
00:00:57planted during the war time. and there will be talk in
00:01:01Washington also that after the 60 days supposedly there will be
00:01:04nobody controlling the straight of
00:01:06of hermus uh obviously the Iranians will try to say that this
00:01:10is an interim agreement but after the 60 days there will be some kind
00:01:14of control or sovereignty the Iranians will have over the straight off
00:01:18so I think the language will remain
00:01:20in a way ambiguous which will give kind of
00:01:25a margin of for each side to say that this agreement represents
00:01:28victory uh for Washington. and even for Tehran uh, but
00:01:32the focus in Washington is on phase two, and this is why I
00:01:35mentioned earlier in my
00:01:37of comments that Washington is
00:01:40moving from coersive diplomacy if you
00:01:43of will, which we are still having because there is still military pressure, but towards
00:01:47another kind of diplomacy, which is phase diplomacy, meaning that we
00:01:51want to finish with phase number two, get the straight of hermus open
00:01:55for international navigation and move towards phase number two, which
00:01:59is discussing with the... Iranians, their nuclear
00:02:02of program and their highly enriched uranium, and that will again be under
00:02:06military pressure, because if these negotiations fail, we will be
00:02:09again uh going back to the air campaign and targeting other
00:02:13possibly uh military uh targets within the Iranian
00:02:17borders. uh, in other words, the focus in the coming 60 days will
00:02:21be on what President Trump said from the early days of this
00:02:25war, that the strategy is to make
00:02:27of sure that
00:02:28of Iran doesn't have uh nuclear capabilities uh
00:02:32for military purposes, but this is let's remember, this is again
00:02:36going to
00:02:39of be very uh long process, because at the end it's not going to be in numbers only, there will
00:02:43be lot of technical talks, there will
00:02:46of be lot of discussions also on the verification measures, it's not only enough to
00:02:50say that this is what Iran
00:02:51a is allowed to do and what not allowed to do, there should be kind
00:02:54of
00:02:56of of measuring and verification uh processes and that
00:03:00means necessarily that there should be other parties involved, this could be the
00:03:04Europeans, this could be the
00:03:07a for example, and there should be also some kind
00:03:11of agreement over
00:03:14of if a Iran doesn't doesn't of
00:03:18of course follow these agreed upon measures, what are the
00:03:21consequences? will we have back economic
00:03:25sanctions imposed on Iran, will there be kind
00:03:28of of military procedures? "these are all questions which remain, in my opinion
00:03:32if we are successfully moving from phase one
00:03:36straight of hermus towards the second phase,
00:03:40a there could be possibility of
00:03:41a extending possibly the 60 days to other 60 days if there
00:03:45is
00:03:45of positive signence that these these talks are going in the right
00:03:49direction, but there is lot of of of devil in the
00:03:53details as they say, and i
00:03:57think from what i hear from the Iranian" officials, as I mentioned
00:04:01earlier in my comments, the straight of hermus will remain a
00:04:04very much hedging point in all these discussions
00:04:08of and this will give leverage also to the Iranians
00:04:12to prolong the talks regarding the nuclear program,
00:04:16and there is an opinion in Iran, let's remember this, that this
00:04:19war and these negotiations can outlive
00:04:23the US administration, the current Trump administration,
00:04:27of and that is possibly something Trump will not... allow to happen,
00:04:31so we may hear at sometimes and see sometimes
00:04:34reverting again to military action, so there is lot to wait and see,
00:04:38and i i think again there is
00:04:41a divel always in these details. right, thank you very much, dr.

00:04:48of room today, there's of course lot of aspects to this discussion
00:04:51moving forward, and we're going to be taking a look at that in further detail as the
00:04:55situation progresses, especially in terms of what the agreement
00:04:59between. and
00:05:00is going to transpire towards, that will be the focus of course for
00:05:04another day, and next we're going to take a look at what is happening
00:05:08as
00:05:08of part
00:05:08of the very important induswaters treaty and what India has held in.
00:05:13This is very, very integral issue for Pakistan and something
00:05:16that India cannot do as part the treaty, and the kind of
00:05:20international legal course that it's taking is also
00:05:23validating Pakistan stoms on the matter, and we're going to be taking
00:05:27closer look at what that means and what are the future options for the country. For
00:05:31that, we've been joined by Dr. Huma Bakai is security analyst from Karachi. Thank you
00:05:35very much Dr. Homa for being part the show today. I'd like your
00:05:38perspective in terms of what you think will be the next steps. part the
00:05:42permanent court of arbitration, we've seen that despite
00:05:46India's status and claim of holding the treaty an
00:05:50abence, which of course it cannot do, we've seen that the international momentum
00:05:53is continued, the permanent court of arbitration is also moving forward with its work as
00:05:57part the neutral process to in terms of what is happening
00:06:01legally, how do you think that the situation is going evolve further
00:06:05if India continues to not participate in
00:06:09these legal proceedings and does not provide the data that
00:06:12it is as to do so? well, frankly
00:06:15speaking, India is on very thin
00:06:18eyes. there is nothing in this that goes in favor of
00:06:22India so to say, because it is on the wrong side of international
00:06:26law, and it will also fall on the wrong side of
00:06:29history. the only thing that is problematic at this moment
00:06:33in time is that India takes an inspiration from
00:06:36Israel, and India, especially under Modi, thinks
00:06:40that it can buy, marginalized
00:06:44international norms, but this particular
00:06:46treaty, indus water treaty is one the most successful
00:06:50confidence building measures or institutional
00:06:54arrangement that has existed between two nuclear
00:06:58armed neighbors who are are not in
00:07:01very good relationship, we are very india centric in our
00:07:05security construct, india is very pakistan centric in its
00:07:09security construct and that is sort of depicted. by the
00:07:12deployment India does and by the military build
00:07:16up that it does, so and when did this happen? this happened
00:07:20after India used terrorism, the bogi it has been
00:07:24using for now 20 years to sort of
00:07:28inflict pain on Pakistan, and when it was defeated in the
00:07:31sindoor operation, it continued with the so-called
00:07:35abiance. now the term abiance does not
00:07:38exist in the lingua the treaty itself.
00:07:43so there is no justification that India has to carry
00:07:47on with this, but more importantly, if this
00:07:50treaty fails or collapses, then
00:07:54essentially we are setting a very dangerous
00:07:57precedence of institutional
00:08:01umbrellas for treaties or how treaties will function
00:08:05in the future, and that is why I think the timing
00:08:09the way India is behaving is extremely critical.
00:08:12"and
00:08:13that is why the international pressure must come upon India
00:08:17to call back this abiance on how
00:08:21you think that the treaty will actually collapse, you mention that that's
00:08:25going to be disaster, but in terms the legal protocols
00:08:29and safeguards that are in place as part the Indus Waters treaty,
00:08:32how exactly do you think it will collapse if India of course completely refuses its
00:08:36international obligations continues to act in ways that
00:08:40it is already doing so and working towards..." is there no
00:08:43consequence embedded within the system to be able to hold India
00:08:47accountable or stop its actions? I say the present
00:08:50global situation is red flag. It is how
00:08:54international organizations are being marginalized and they are
00:08:58unable to hold states accountable. The whole concept of
00:09:01collective security is more diluted today than ever before
00:09:05and also the institutional umbrellas because of it. But having
00:09:09said this, India needs to realize that Pakistan has
00:09:13time and again exercised strategic restraint in responding to
00:09:16India about what it is doing with the water, India has been using water
00:09:20as a weapon for Pakistan for years now,
00:09:23and Pakistan has constantly exercised strategic
00:09:26restraint in responding to that, but more
00:09:29recently the military leadership of Pakistan has
00:09:33been more categorical, they say the lifeline of Pakistan
00:09:37will is touched by India or if water organiz to
00:09:40point where it hurts Pakistan.
00:09:42the then Indian Pakistan may respond back in
00:09:46terms which you will can be painful for India, so I think that is
00:09:50the consequence of this, and moreover, can India really
00:09:54afford to go to war with Pakistan? hasn't the sindoor operation
00:09:57taught enough lessons as had enough lessons for the Indians,
00:10:01so what they eventually do is that they do wars by
00:10:05other means,
00:10:06putting interest water treaty and abiance is the
00:10:10Indian attempt of war. by other means
00:10:14Pakistan has acted with maturity, it has
00:10:18acted, it has exercised strategic restraint, but
00:10:22water is something else, water is Pakistan.
00:10:25lifeline and there if it
00:10:29continues the way it is and from saying that
00:10:32it is held in abiance it starts diverting
00:10:35Pakistan's water or India is very water stressed
00:10:39country
00:10:39it has designs of irrigating a desert
00:10:42Rajasthan and all of that has implications for
00:10:46Pakistan and India has been trying to get out the treaty for
00:10:49years India has been talking about Indus water treaty to India is talking
00:10:53about climate as a factor. which should impact in the
00:10:57the water flows into Pakistan, so India has been trying to find
00:11:01ways to cut water Pakistan's water or to flood
00:11:04Pakistan, does this weaponization of water needs
00:11:08to stop, and absolutely, I mean it's
00:11:12fairly obvious that when India says the treaty is in abiance
00:11:15then it's trying to get out the treaty, if you look at the clauses the treaty, it
00:11:19is neither time specific nor event
00:11:22specific nor government specific, it
00:11:26is between two states brokered by the world bank. if
00:11:30it is not event specific, how can use India
00:11:34use false flag operation of which it could provide
00:11:38no proof or evidence to India or the intern to Pakistan or the
00:11:41international community, how can it use it,
00:11:45how can it use it to put the treaty in abiance when the treaty itself does
00:11:49not have clause of abiance, something which has been stated by
00:11:53the abitation court. in June
00:11:562025, so like I said, India is on very thin
00:11:59ice, as per water laws, there is no
00:12:03way India can get away with this, right,
00:12:07absolutely. Dr. Hima, when we take a look
00:12:11at the actions
00:12:12that then of course correspond
00:12:14to climate change
00:12:16and climate introduced disasters in Pakistan, it's an added war for the
00:12:20country, we've seen even now that there are warnings
00:12:24with regards to... rains and the impact that it creates and then of course with the
00:12:27kind of actions India takes that also adds to the troubles that Pakistan is
00:12:31facing, how much of this constitutes as water terrorism and how can
00:12:35Pakistan talk about this with not just the world bank or the permanent court of
00:12:39arbitration, but also other other departments that
00:12:43are looking into climate justice and climate financing, how can
00:12:47those platforms also be made aware of what
00:12:50is being added to this issue because the Indus Waters
00:12:54treat. in the actions that India is taking, well Pakistan is raised
00:12:58the issue at the United Nations, Pakistan is raised this, it's taken to
00:13:02taken it to the mediators, it has done its share of water diplomacy, we've
00:13:06just recently had water summit in Pakistan where we
00:13:10identified all these issues and there were scholars, it was an international
00:13:14summit, there were scholars from all over the world who validated Pakistan's point of
00:13:18view, actually you know this is something I said right at the beginning of this
00:13:22conversation, it's not that what
00:13:25India can do or what India is doing is right or not? right
00:13:29now the question is that is is India trying to get
00:13:32away with weaponizing water against
00:13:36Pakistan by sort of taking advantage
00:13:40of a global environment which allows violations of
00:13:44international law and they go
00:13:46unpunished. That is a real concern, not so
00:13:50it's not a bilateral issue between Pakistan and India,
00:13:53it's this should be an issue. which should be source of worry for all
00:13:57the treaties and the sec and the and the architect security
00:14:01architecture that exist under these
00:14:04treaties, because if treaty violations becomes norm and there
00:14:08are no repercussions for it, it is not just a problem for Pakistan,
00:14:12then it's a global issue, there's several other
00:14:16issues that several other treaties that exist, and by the
00:14:19way, the issue starts because what India has
00:14:23also been hedging, sharing of data, you sharing is
00:14:27caring, so sharing the data is the first step towards this
00:14:31confidence building measure, something that India has been trying to
00:14:35prevent for years now, and to
00:14:39keep the optics alive, they will send a commission to
00:14:42Pakistan, but then continue to violate the treaty by building
00:14:46up dams or diverting water, which Pakistan has also
00:14:50identified as violation the treaty and taken it to
00:14:54the courts. and the relevant forums, but our concern
00:14:58right now is that will this come to point where Pakistan will have to
00:15:02respond to this bilaterally, if the international community
00:15:05fails to restraint India for continuing to
00:15:09violate this treaty, and the first step should be that it takes back the
00:15:13stance that the treaty is abiance because it has no legal roots, no
00:15:17legal standing, the treaty does not allow you to
00:15:21put it into an abiance, it is not event specific.
00:15:25but what India has turned it into is event
00:15:28specific treaty abinence, it
00:15:32it is trying to get out the treaty over event for which it has no
00:15:35proof, it could neither give any proof, first it cannot do it, even if it
00:15:39is true, it is not,
00:15:41it is false flag operation, India could not provide any
00:15:45evidence to Pakistan, to its own
00:15:48people, to its own parliaments and of
00:15:52course to the international community, I mean India has been called out for it,
00:15:56for what it is doing by its own people, especially the Modi government, so
00:16:00I just wonder if issue like water can be
00:16:03held hostage by the toxicity of politics in a country.
00:16:07which is now revolting against its own form of its
00:16:11own government, its own leader and
00:16:15absolutely understand that that of course has to change, but unfortunately there's so
00:16:19much that is being made in India and this is of course affecting not
00:16:22just real peace and stability but India itself. thank you so much dr. huma bikai for

00:16:30that is closely linked with India's actions and that of course is

00:17:04has happened about seven years ago now this is of course the
00:17:08continuous struggle the people of Kashmir have been facing, but what is
00:17:12fundamentally very, very important to keep on remembering about
00:17:15what happened on the 5th of August in
00:17:182019? Thank you
00:17:22very much for having me, we all know that Kashmir
00:17:25remained always under the Indian occupation right since
00:17:291947, the occupation was brutal, it
00:17:33was militarized, it has done every sort
00:17:36of... injury to the hearts and minds the people of Indian
00:17:40occupied Jammu and Kashmir, but what happened on 5th of August
00:17:442019 was that India betrayed its
00:17:48own constitution, it violated its own constitution and by violating
00:17:52its own constitution it took away the the
00:17:55constitution which was given to the people of India and occupied Kashmir, the flag which
00:17:59was given to them and dismembered the state into two union
00:18:03territories and why India did it
00:18:07we
00:18:08these are two things on one hand that the current Indian government which is
00:18:12led by BJP and it's the
00:18:15ideological background is RSS, it was their main motive
00:18:19to remove these articles from the day
00:18:23one and so they removed this in order to change the
00:18:27demography of Indian occupied Jammu Kashmir
00:18:29implement the Hinduta
00:18:32ideology its agenda in Indian occupied Jammu and Kashmir
00:18:36to make it a Hindu majority area and to put
00:18:40more and more Hindus there and thereeb they changed many laws
00:18:44in Kashmir and they
00:18:46did a constitutional assault in inoccupied Kashmir along
00:18:50with the military assault the draconian laws which they had already
00:18:54emplied there so from 5th of August
00:18:57onwards we saw the land grab, we saw the demographic
00:19:01change, we saw the jerymandering of assembly segments in such a
00:19:04way that the more... more and more
00:19:08Hindus come to the this state
00:19:11assembly that which now is called the
00:19:14union territories unfortunately and
00:19:17also we could see the eraser of
00:19:21Kashmiri's identity, Kashmir's literature, Kashmir is
00:19:24culture, and at the top of it we have
00:19:28seen that how the militarized governance in
00:19:32Indian occupied Kashmir has intensified
00:19:35since 2000. 19
00:19:39onwards
00:19:39on one hand they staged drama of elections in
00:19:432024 at directions the Indian Supreme Court but
00:19:47unfortunately that elected government which is
00:19:51which has been installed over there that lacks any powers every power
00:19:55is held by the left hand governor
00:19:59who is directly under the Indian home ministry
00:20:03Amit Shah is running the show in Kashmir so Kashmiri
00:20:06people Muslims of Kashmir have not only be
00:20:10disintegrated, they have been disempowered, they have been
00:20:13dehumanized, their land is being taken, we have seen
00:20:17from 20
00:20:2019 onwards that assault on the
00:20:24properties the people, the people, the those who
00:20:28are struggling for this right to self information,
00:20:32their properties have been confiscated, their lands have been
00:20:36confiscated. "their houses are being
00:20:39demolished a very small incident which happens over there,
00:20:43which India itself creates a security situation crisis in
00:20:47Kashmir and thereeby a collective punishment. to the people
00:20:51of Kashmir is handed over by the
00:20:54Indian forces, by the Indian
00:20:58these with arm with the draconian laws,
00:21:01nobody can speak for that, even the human rights
00:21:04defenders or were
00:21:07for all these this time they were behind the
00:21:11b, only few days back the two
00:21:15of human rights defenders, one noted human rights defender of Kashmir Koram Parvez
00:21:19and Irfan Miraj, they were released by
00:21:23the court, but they were asked to stay in New Delhi
00:21:26900 kilometers away from their home and
00:21:30not to speak publicly, not to give any public
00:21:33statement, not to talk to press and not to do the work they
00:21:36used to do to document the human rights violence in Kashmir,
00:21:40so the eraser of memory in Kashmir, the the
00:21:44eraser of our culture and all that, and at the top of it
00:21:47is the threat to the...
00:21:51to the religious rights in Kashmir, we could see that on
00:21:55one hand yatra is conducted under full
00:21:58security, more and more Hindus are encouraged to visit
00:22:01the Amarnath and to
00:22:05what what they are causing there, people have seen the images
00:22:09that how the environment and ecology of Palgam and Nal
00:22:13Loder is being disturbed by these lots of
00:22:17pilgrimage, but on the other hand people the... Muslims of Kashmir are
00:22:21not allowed even to gather together on the eight
00:22:24congressions, they are not allowed to gather together on Friday
00:22:28congrations, the leaders are being put behind the bars
00:22:32and all the shines and masks have been taken over
00:22:36by the work board which is run by the government, so the
00:22:39surveillance of masks of imams and everybody coming to the
00:22:43mask is being scanned everywhere and
00:22:47all those political parties have been banned. religious parties have been banned, their
00:22:51schools have been taken away, so this is how India
00:22:55is implementing it is settler colonism in Indian
00:22:58occupied Kashmir, that
00:23:00colonism to is an
00:23:04ideological colonism through Hinduta
00:23:07mindset. Right, also when we take
00:23:11a look at the ways in which the
00:23:14BJP government is acting, not just in
00:23:18the occupied valley but of... or other parts of India, we
00:23:22have seen that there is at least some sort of opposition to those
00:23:26actions that is sparking now in different parts the
00:23:30country, how do you think that Indian voices are also
00:23:33at what is happening in the illegally occupied uh
00:23:37territory and what really do you think can be
00:23:41made difference because of those voices to the state of
00:23:44affairs?
00:23:49there was... once once upon a time there was a indian civil
00:23:52society which used to speak for the human rights
00:23:56violation in indian occupied jammu and kashmir not nearly the political
00:23:59rights but the human rights abuses which Indian armed forces w
00:24:03committing over there they used to speak for that you
00:24:06have know how Arundathi raitam navlakkha
00:24:10and others w treated they were those were charged
00:24:14with sadition why you are talking about the
00:24:18rights the people of kashmir you have seen the students protest in
00:24:22JNU, how those students are sittle
00:24:25facing the reprisals and persecution
00:24:29by the Indian government, so even those
00:24:32san people in India who used to speak for the rights the people of
00:24:36Kashmir, violence, their voices were already silenced
00:24:40by this government, but more recently the Indians have come
00:24:44to know after this jantar mantar attacks and jantar
00:24:48mantar protest when the plats will fire there, they came to
00:24:52know what really the pat gun is,
00:24:55because before that they did not know how these patrot injuries have
00:24:59been have caused the blindness in Kashmir which the New York
00:25:03Times called the year of blind eyes,
00:25:07so epidemic of blind eyes, so the Indian civil society
00:25:11has also been taken over by these hindu, you see that
00:25:15each and every organ of state in India has
00:25:19been taken over. by these hindu
00:25:22extremist groups and these are condoned by the Indian
00:25:26government, there the Indian government condoms each and
00:25:30every act we have seen those people rapping the Muslim
00:25:33girl and then the the high court and the courts
00:25:37release them and they are being garlanded by the BJP leaders, all the
00:25:41BJP leaders and even the chief minister
00:25:44of UP and also that Haryana is
00:25:48on record when the article 370 and 35 was
00:25:52obrigated how they issued hate
00:25:56based statements against the people of kashmir and
00:26:00muslims in of course is adding to what is
00:26:03happening in the occupied valley and must be something
00:26:07that has to have the attention the international community, what Pakistan of
00:26:11course essentially aims to do
