00:00:02I conclude our discussion, thank you very much and as usual, I advise
00:00:06our viewers to hire specialists in whatever they
00:00:10want to do, sometimes it's better and always much
00:00:13cheaper. Thank you very much. Thank you too. I
00:00:16invite you to continue watching the Info section to be the

00:00:26The European Commission has adopted the package on fair labor mobility
00:00:30to guarantee clear social rights for everyone,
00:00:33anywhere in the Union, regardless of the space they choose to live and
00:00:37work in. The measures will allow workers to
00:00:40prove and claim their social security
00:00:44and health insurance rights, and
00:00:46their qualifications will be officially recognized where
00:00:50the profession is regulated. The legislative
00:00:53proposals have been sent to the European Parliament and the Council
00:00:56of the European Union for analysis, amendments and final approval.
00:01:00Ms. Georgiana Teodorescu, member of the European Conservatives and
00:01:03Reformists Group and Vice-Chair of the Committee on
00:01:07Employment and Social Affairs in the European Parliament,
00:01:10is on a direct phone line with us. Good evening, Ms.
00:01:13Teodorescu.
00:01:15Good evening, thank you very much for the invitation. And thank you for accepting it. What is
00:01:19this long-awaited
00:01:21package about?
00:01:24It's a complex package. At the moment we are at
00:01:27the legislative proposal stage. So we are not talking about final
00:01:31legislation, the commission proposes
00:01:34five important
00:01:37issues, we have: European Social Security Pass, Skills
00:01:41portability Act, Strengthening the European
00:01:44Labor Authority Ela, modification of the directive
00:01:48on the recognition of professional qualifications, and this is a very
00:01:51important one and I will come back to it, as well as rules for the recognition
00:01:55of qualifications of citizens from third countries. The idea is
00:01:59very simple. European mobility must
00:02:02be accessible to everyone, it must be an
00:02:05opportunity for Romanians, but by no means from our point of
00:02:09view an obligation to leave Romania. We want
00:02:13emanate from Romanian citizens who have left, and unfortunately there are many
00:02:16who have left and are now living in the diaspora, we are talking about millions of
00:02:20Romanians, we want them to return to the country, for the country
00:02:24to offer them everything they need to return with certainty, neither the commission nor do I think it
00:02:28A1 document. Three years wants this, but even in the current situation where
00:02:31they live there, have their families there, children studying
00:02:34there, we must ensure that they benefit
00:02:38from all possible rights there in the countries where they
00:02:41are. This is the attempt, what
00:02:44amendments will Parliament bring, because, as
00:02:48I said, the commission has sent this legislative package to parliament
00:02:51for amendments, right? Well, let's
00:02:55talk, for example, about the recognition of qualifications, which is
00:02:58a very important issue for
00:03:01that entails, Romania. The Commission proposes the digitalization of qualifications
00:03:04and faster procedures for the recognition of regulated
00:03:07professions. For certain types of professions,
00:03:11the procedure should take approximately five
00:03:14weeks, compared to how long it takes now, which is
00:03:17approximately three months. For qualifications obtained outside
00:03:21the European Union, a reduction in average
00:03:24procedures from about a year and
00:03:27Romania, but have such an
00:03:28the date of occurrence something to four months
00:03:30is also estimated. "This is a very good thing for Romanians, Romanians are very well-trained
00:03:34European citizens, the problem is that too often the European system
00:03:37treats them and treats their diploma as a piece of paper
00:03:41that needs to be endlessly verified and which is not
00:03:44always accepted in EU
00:03:48member states in the true sense of the word and at its true
00:03:51value, basically this is trying to
00:03:55solve, isn't it, this problem, certainly it is precisely
00:03:58this". will be done and I will insist
00:04:02as much as I can through amendments, so
00:04:05that these procedures are simplified and so that we are firmly
00:04:08convinced that if, for example, a Romanian engineer or a
00:04:12nurse or a physiotherapist or a teacher from Romania has a
00:04:16qualification that is recognized in Romania, there must be a very simple,
00:04:19fast and transparent European procedure so that the same qualification can
00:04:23be used in another member state, equally
00:04:26a Romanian citizen who managed to obtain a qualification. in
00:04:30Italy or Spain, for example, where they worked for years, to be able to
00:04:33come very easily with that qualification to Romania and be
00:04:37able to get a job here if needed. So, a beneficial measure, especially
00:04:41for Romanians, it is a very good measure, it will be a very
00:04:44good measure. What is this European social security
00:04:48passport? Well, here again there
00:04:52are some very good things. The Commission proposes that
00:04:56a series of documents can be accessed and presented digitally
00:05:00through the European digital identity wallet, and these documents
00:05:04are many, it's the European health card, it's the A1
00:05:07document for posted workers, other documents related
00:05:11to social security, in essence, citizens will be able to
00:05:15access their social security rights through this
00:05:18EU digital identity wallet,
00:05:21but we have been quite critical about
00:05:24this digital wallet and we continue to be, and the good
00:05:28thing we must acknowledge from this commission proposal is that
00:05:32paper formats will remain
00:05:36available, so through the EU digital wallet
00:05:40there is no complete abandonment of... the old
00:05:43classic paper formats, no, it is an additional
00:05:46option for those who want it and want to have
00:05:50such an EU digital wallet can
00:05:53use it. Also, companies will use
00:05:56much simpler and standardized digital procedures when
00:06:00posting workers abroad, which,
00:06:04of course, will lead to a reduction in the volume of documents, as well as
00:06:07in waiting time. Yes,
00:06:10you mentioned, among the measures that you listed from this legislative
00:06:13package, the role of the European Labor Authority, which
00:06:17is led by a Romanian, yes, Mr. Boiangiu, ELA should
00:06:20be strengthened. ELA,
00:06:22practically, it is desired to grant
00:06:26stronger instruments for a series of things, such as
00:06:29cross-border inspections,
00:06:32exchange of various information between member states, risk
00:06:35analyses, mediation between national authorities when problems
00:06:39arise, as well as, of course, combating undeclared
00:06:43work and abuses. We are for a European market in
00:06:46which competition is based on productivity and
00:06:50competence, of course, not on worker exploitation.
00:06:53So, from this point of view, a Romanian worker must have
00:06:57the same rights when working legally in any other member
00:07:00state, as they do in Romania. I understand, it's a very
00:07:04important thing from our point of view again for Romanians who have
00:07:07left for the diaspora and work, and very often work in very
00:07:11difficult conditions, without documents, because employers
00:07:14refuse to make documents for them and so on. Do you have an indicative
00:07:18calendar of the possibility, or rather, when it
00:07:21might enter into force, is there also a
00:07:24calendar? The question is, when does
00:07:27implementation begin? Well, within a year from its entry into
00:07:30force, the main document necessary for
00:07:34posting workers to other EU countries will be
00:07:37digitized. We're talking about that
00:07:41from the entry into force of this legislative package, the European
00:07:45Health Insurance Card and all
00:07:47other social security documents will be
00:07:50digitized, so it would take three years. Regarding
00:07:54the calendar in Parliament, we are now at the stage where
00:07:57we are waiting for the commission's proposal
00:08:00to come, this package has been announced, but it has not yet reached
00:08:04the employment committee I am part of, as
00:08:07soon as it arrives, the files will be allocated
00:08:11to parliamentarians and we will start working on them,
00:08:15we hope to finish them as soon as possible, in a few months, a maximum of one year, to bring them to a
00:08:19vote in plenary, we hope the same, thank you very
00:08:22much, good luck and I look forward to good news, thank you
00:08:25too.
00:08:30It is good to know who has the obligation to register
00:08:34fiscally in Romania, even if they do not live in
00:08:39obligation. The non-resident
00:08:43natural person in Romania, who owes
00:08:46taxes, fees and contributions in
00:08:49Romania and who does not have a personal numerical
00:08:53code, is obligatorily
00:08:56required to register fiscally,
00:08:58receiving from the tax authority a tax
00:09:01identification number.
00:09:04Tax registration can be done
00:09:07personally or through a representative.
00:09:11The designation of the representative is done either through
00:09:14a mandate with representation, a power of attorney that
00:09:18expressly specifies that they are empowered to carry out such
00:09:22operations, namely tax registration
00:09:25and obtaining the tax identification number,
00:09:29or based on a legal assistance contract by
00:09:33which the lawyer in Romania is mandated
00:09:36to carry out such legal activities,
00:09:40namely tax registration and assignment. of the tax
00:09:43identification number, even assuming the quality
00:09:47of representative or tax proxy, and
00:09:50we will clarify what this aspect means. In case,
00:09:54so it is a taxpayer,
00:09:57a foreign natural person, who has not been assigned the tax
00:10:00identification number, they will be able to
00:10:03complete form
00:10:06030, submitting it to the tax authority,
00:10:09personally or through a representative, and based
00:10:13on it, that tax identification
00:10:16number will be assigned. The submission of declarations
00:10:19provided by the legislation in force, as well as the payment
00:10:22of established taxes. will be
00:10:25carried out by the tax authority in whose territorial
00:10:28jurisdiction the taxpayer's domicile or residence
00:10:32is located,
00:10:34respectively where the source of income is,
00:10:38as the case may be, because in the case of a non-resident
00:10:41person, it is obvious that they either have a source of income in Romania,
00:10:45or they have a property in Romania,
00:10:49which would necessitate the payment of certain local
00:10:53taxes and fees. Upon the
00:10:56submission of the first declaration by the tax
00:11:00representative, a copy of the authorization is also submitted, whether
00:11:03it is a power of attorney or a lawyer's authorization,
00:11:07as the case may be. Specifically,
00:11:10what would be the situations that require
00:11:13obtaining the tax identification number? We have
00:11:17the hypothesis of non-resident natural persons in Romania who
00:11:21obtain income from salaries in Romania.
00:11:26In this hypothesis, these
00:11:28persons are fiscally registered through the
00:11:32income payer, i.e., the one who pays
00:11:35that salary, and on that occasion, the tax
00:11:38identification number is obtained until
00:11:42a document issued by the General Inspectorate
00:11:45for Immigration is obtained, through which a personal
00:11:48numerical code is allocated. After
00:11:51the issuance of this document, the tax authority
00:11:55records in the tax records the tax
00:11:58identification number with the personal numerical code
00:12:01based on form 030 700 submitted
00:12:04by the income payer. Another hypothesis in
00:12:08which tax registration of non-resident natural persons
00:12:12is necessary is the situation in which
00:12:15they are founders,
00:12:19associates, shareholders or administrators of a
00:12:22commercial company. In
00:12:25these hypotheses, non-resident
00:12:29natural persons will need to obtain
00:12:32such a tax identification number at the
00:12:35time of registration of the company with the trade register,
00:12:39at the time of transfer of social shares or
00:12:42shares, at the appointment of new legal representatives, so
00:12:46in such hypotheses, the TIN is
00:12:50mandatory. A distinct hypothesis
00:12:53is that of non-resident natural persons who
00:12:57open a bank account in Romania, or when
00:13:01they even rent a safe deposit box, and in
00:13:04this situation, credit institutions transmit to the competent
00:13:08tax authority the request for the assignment of a tax
00:13:11identification number. However, there can be
00:13:15situations where this is the hypothesis in which the non-resident
00:13:18natural person enters into a direct relationship with the credit
00:13:21institution. However, there can be multiple factual
00:13:25situations in which a non-resident person, who
00:13:28needs to receive, for example, a sum of money as
00:13:32compensation from the Romanian state, and in such a
00:13:35hypothesis, when the Romanian state pays
00:13:38by check, so that you can make
00:13:41international transfers much easier, which
00:13:44concern the collection of these compensations, and I give
00:13:48the most common example in the last period of collecting
00:13:51compensations from the National
00:13:54Commission for Compensation of Immovables under Law
00:13:58165/2013,
00:14:00the amounts are transferred by the state to CEC, but then
00:14:04their transfer to an account in a foreign
00:14:07country, sometimes it is useful to do this
00:14:11after the non-resident person has previously
00:14:15opened an account in Romania from which they can
00:14:18then transfer such amounts, perhaps to several
00:14:22countries, the operations of CEC are limited, and
00:14:25then it is useful to open such an account. Also,
00:14:29non-resident natural persons who
00:14:32owe local taxes and fees are
00:14:35also subject to this obligation of fiscal registration
00:14:39and obtaining the tax identification number.
00:14:43The hypotheses are the acquisition of a
00:14:46property, the sale of a property, the settlement of an
00:14:49inheritance, the most
00:14:52convenient example would be if you are a Romanian
00:14:56citizen, but who may have lost citizenship, or even
00:14:59if you are not a Romanian citizen, you are a foreign
00:15:03citizen, non-resident in Romania, but who inherit something in Romania,
00:15:07in order to be able to settle the inheritance, in order to be able to
00:15:10register the properties that are the object of that
00:15:13inheritance, in the land registry, for example,
00:15:17you must also have this tax identification number in the hypothesis that
00:15:21you have not previously received a personal numerical code.
00:15:25Because there are also such situations for people who may have left
00:15:28Romania long before
00:15:32the regulation of the personal numerical code and have not
00:15:35regained their citizenship or updated these civil status
00:15:38documents to receive the personal
00:15:42numerical code, so in such hypotheses it
00:15:45is possible and even
00:15:48necessary to obtain this tax
00:15:52identification number, because obviously
00:15:55the tax registration of a property in the name of a
00:15:59non-resident natural person then entails the payment of local
00:16:03taxes and fees which are paid with this correspondent of the tax
00:16:06identification number. Regarding
00:16:10strictly the procedure for obtaining the tax identification
00:16:13number, as I stated earlier,
00:16:17the identification number is obtained by submitting
00:16:20form 030, it is a
00:16:22form that concerns
00:16:26the tax registration declaration, declaration of
00:16:29mentions, declaration of deregistration for natural
00:16:32persons who do not have a personal numerical code and
00:16:36to which it is... it is attached, so the form is
00:16:39submitted to the tax authority and the supporting
00:16:42documents for the information contained in the declaration are
00:16:46attached: for example, we have an inheritance, a
00:16:49property acquired through inheritance and
00:16:53to be able to be registered, transferred the tax role in the
00:16:56name of the heir who is not
00:17:00resident in Romania, it is absolutely necessary to obtain
00:17:03this tax identification
00:17:06number to which, obviously,
00:17:09documents relating to passport,
00:17:13identity card, to
00:17:15the act from which the ownership of that property in Romania
00:17:19results, which entails, let's say, the payment of local taxes and
00:17:22fees, the act of appointing the representative or
00:17:25tax proxy, respectively a power of attorney or a
00:17:28lawyer's authorization for that tax representative,
00:17:32if the declaration is submitted through
00:17:35a tax representative. And in general
00:17:39any document from which the reason for
00:17:43requesting that tax identification
00:17:46number results. When it comes to documents that
00:17:50authorities other than Romanian,
00:17:53obviously they will have to be submitted in a
00:17:56translated, legalized form,
00:17:59with all the
00:18:02authentication elements,
00:18:05effectively super-legalization if it
00:18:07concerns acts that emanate from authorities in countries
00:18:11other than those of the European Union. What
00:18:14is the deadline for declaring the tax registration
00:18:18declaration, of mentions or
00:18:21of deregistration for the mentions
00:18:24in the tax registration. Form 030 is
00:18:28submitted within 30 days from the date of obtaining
00:18:31the first income in the territory. or from
00:18:35the date of the event
00:18:38as I said, the payment of taxes, fees or
00:18:41the quality of
00:18:44associate in a company, as I gave
00:18:48those examples, which generate this
00:18:51need to submit
00:18:55declaration 030. Also, we have
00:18:58an important deadline, 15
00:19:02days from
00:19:05of changes to the data
00:19:09initially recorded in a tax registration declaration,
00:19:12namely when form
00:19:16030 is submitted with
00:19:19the box "Declaration of
00:19:22Mentions" checked, or the electronic form
00:19:25700 entitled "Declaration for
00:19:28the registration, modification in the electronic environment of
00:19:32subsequent mentions to fiscal registration as well as
00:19:35the cancellation
00:19:38of fiscal registration." How is
00:19:41this form 030 or form 700 submitted
00:19:45in practice, as the case may be?
00:19:48This can be downloaded from the ANAF
00:19:51website. It is completed and submitted either
00:19:55in physical format at the tax authority's
00:19:58registry, or by post, by registered
00:20:02letter, or by electronic means of remote
00:20:05transmission, but which ensure
00:20:08with certainty that the transmission has operated and
00:20:11reached the recipient. Also, through the
00:20:15virtual private space, the service provided by
00:20:18ANAF, by selecting the contact
00:20:21form, category, assistance and specialized guidance in the fiscal
00:20:25field and attaching this form 030 in
00:20:29PDF format. Last but not least, through the
00:20:32portal www.eguvernare.ro.
00:20:35by using in this
00:20:37situation a qualified
00:20:41digital certificate in the case of submitting
00:20:44electronic form 700, so if in the other hypotheses it
00:20:48is not...
00:20:50such certification of the signature on
00:20:53the form is not necessary, in
00:20:57case this transmission platform is opted for,
00:21:00the qualified digital certificate must
00:21:03also be attached obligatorily. It is very
00:21:07important to note what the sanctions are
00:21:10for not submitting this tax registration declaration
00:21:14for non-resident persons in Romania, but
00:21:17who are in the hypotheses we presented.
00:21:20Failure to submit within the deadline we
00:21:24mentioned, 30 days, respectively 15 days,
00:21:27these declarations
00:21:28entails
00:21:31a fine as an administrative
00:21:34sanction, a fine between 500 and 1000
00:21:37RON for the person who should have made
00:21:41such a declaration and did not do so within the legal
00:21:44deadline.
00:21:49This was it. from this evening, thank you for your attention and I invite
00:21:53you to forget about the campaign Romania closer to you, goodbye and
00:21:56have an excellent evening.

00:24:02The largest collection of motorcycles in Romania,
00:24:05unique in Eastern Europe, is located in a village in Suceava,
00:24:09in Horodnic de Jos, and it belongs to Alexandru
00:24:12Șcheul, a Bucovinian dedicated body and soul
00:24:16to his childhood passion, motorcycles.
00:24:23"I started 25 years ago from the first motorcycle that I
00:24:27reconditioned, and
00:24:29every day I kept wanting to bring
00:24:33more, I would get these old things, two or three,
00:24:37I started with the motorcycles that were around during Nicolae Ceaușescu's time,
00:24:40communist as I call them, and I finished with
00:24:44the latest
00:24:46- from the top range, the latest novelties.
00:24:50There are still some, I'm waiting for them to release this now, an electric motorcycle,
00:24:53to bring one of those too. To be able to
00:24:56recondition the motorcycles, he bought a lathe, a milling machine,
00:25:00grinders, paint guns, everything he
00:25:03needed. The few piles of iron from
00:25:05before now restore the former shine and
00:25:09the overwhelming emotion of those who come to see them.
00:25:13Each motorcycle came loaded with a
00:25:15story. Most are old, the oldest
00:25:19are. 100 and 12 years old, the oldest are
00:25:23from Eastern Europe. I've
00:25:25had a motorcycle
00:25:29driving license for 44 years.
00:25:31I've ridden everything you see here, they've all passed through my
00:25:35hands. So there are 272
00:25:38motorcycles. I've started them all, they all run, the ones you see here
00:25:42are in working condition. On the right side here we have Romanian
00:25:45motorcycles, Romanian mopeds, because they only made mopeds. They started
00:25:48with the Carpati range, then Carpati
00:25:52Super, which my dad had when I was six years old, my dad bought
00:25:56it and since then I've in love with motorcycles, pretty much
00:26:00everything that existed during Ceaușescu's time. Until
00:26:02'89, I have here in exhibitions starting with
00:26:06Romanian motorcycles, the Carpați, the mobra
00:26:09all of them and the Hoinar, they were made at Metro in Brașov and assembled
00:26:13in Zărnești, so almost all of them are here and that's why I said I should
00:26:17save the communist ones first, so that my grandchildren and future
00:26:19motorcyclists can see what
00:26:22we used to ride. I am Alexandru Șcheu and I would like to
00:26:26carry on the tradition of motorcycling in
00:26:30Romania, my grandfather's. Alexandru Șcheu. I saw
00:26:34in his workshop many old,
00:26:37rusty parts, from which he would later manage
00:26:40to make motorcycles, to
00:26:44repair them, he would rebuild them.
00:26:47Many of the Romanian motorcycles in Alexandru Șcheu's collection
00:26:51bear the imprint of the life lived by Romanians under
00:26:54Nicolae Ceaușescu's dictatorship and the Communist Party,
00:26:58a party that put the well-being of its citizens
00:27:01last. When I met my wife, I had a Jawa
00:27:05250 with which I would
00:27:08commute to work, we were colleagues at work next door, we had
00:27:11two different departments, we worked
00:27:14separately and that's how I conquered her with that motorcycle. When
00:27:18I married my husband, we had
00:27:21few things and a
00:27:23studio apartment, I could say, a small room, in which we had
00:27:27stored many motorcycle parts,
00:27:31among which at the entrance there was even a motorcycle, and under
00:27:34the marital bed there was a motorcycle engine
00:27:38that needed to be changed over the winter, many
00:27:41were in a deplorable state, you know, especially these communist ones,
00:27:45they were in a deplorable state, but I would take two, three
00:27:48wherever I found two, three, the best I could find and from
00:27:52all of them, from two or three, I would make one good one so that it was painted,
00:27:56everything, everything, everything from scratch, every screw disassembled, what you see here
00:27:59I have 10 or 12 that have not been disassembled. The rest of
00:28:02the 270 have all been disassembled and have passed through my hands, I even
00:28:06gave him a motorcycle, I bought it as a gift,
00:28:10I knew he wanted a certain type of
00:28:13motorcycle very much, a Zündapp, but I got him a small
00:28:17Zündapp, it is a financial effort, he invests
00:28:21almost all his money in motorcycling and
00:28:24in exhibitions, I am amazed by his ambition not
00:28:28to give up until he sees the engine start
00:28:31and... uh he is very excited
00:28:35about the success, this year I think we had one of
00:28:38the largest number of visitors among
00:28:41motorcyclists, there were over 500 motorcycles,
00:28:45they came from Suceava, we had visitors even from New
00:28:48Zealand, from America, from Canada, I told you,
00:28:52there are people who love motorcycles
00:28:54and through word of mouth, through the internet
00:28:57the exhibition became known and
00:29:01many people come indeed. Now he bought a motorcycle from
00:29:04England and we are going to unload it, we
00:29:08are also anxious to see if it arrived in good condition, if it is as
00:29:11we saw it in
00:29:14the photos, we are waiting to see it.
00:29:39Captivating stories are the truest ones, without special
00:29:42effects, without makeup, without
00:29:45virtual decor. You have an
00:29:48authentic series, with strong characters and
00:29:52unexpected resolutions. For them,
00:29:55destiny is the best screenwriter. They are
00:29:58the stars of "Destine ca în filme" (Destinies like in movies). With
00:30:02Iulian.
00:30:32signed Luca Niculescu concluded the rounds of consultations with parliamentary parties, we do not
00:30:36know what type of government we will have nor its nominal composition. There are three
00:30:40days left until the deadline for submitting the governing program and the
00:30:43list of ministers expires. A political agreement for six months to support the government
00:30:47on essential issues, not just a vote for investiture. This is the proposal
00:30:51that Luca Niculescu made to the parties from the former ruling
00:30:54coalition. PSD wants a clear majority with PNL and
00:30:57UDMR and evokes the anticipated scenario.
