00:02:18Good time, welcome to the news line at this hour. our heroes and crowns of our heads, You are very welcome. In the three recent
00:02:21imposed wars on our country, in addition to military confrontation
00:02:25and the war of narratives, a full-fledged
00:02:28legal battle is also underway.
00:02:32A battle in which Iran's judiciary is trying to create
00:02:35a basis for international follow-ups
00:02:38and the restitution of the rights of all victims
00:02:42and, of course, those affected by the enemy's aggression
00:02:45by opening cases and, of course, careful legal proceedings.
00:02:49In the latest legal step, the first
00:02:52session to address the case
00:02:55of the 12-day imposed war crime
00:02:58was held in Branch 55
00:03:00of the International Civil Court. To learn about
00:03:04the details of this matter, we invited Mr.Youcefi,
00:03:07Deputy Head of the Center for Lawyers and Official Experts of the Judiciary,
00:03:12The best of processions to join us in the studio. Mr. Youcefi, greetings to you. Hello.
00:03:14Good day to you. I extend my regards and
00:03:19God, to You be praise in the respect to you and all esteemed viewers of the program. I am at your service.
00:03:22May you be well. Thank you very much for accepting our invitation. The first session
00:03:25of the court to address the complaint of the victims
00:03:28and, of course, those affected by the 12-day imposed war was held.
00:03:32What legal steps have been taken? Well, you see,
00:03:35I will say this point afterwards, which people might
00:03:39now say that the time gap between the formation of this court and
00:03:43the time of this crime and this attack has been very long. The discussion
00:03:46is that we have a general rule, and that is
00:03:50that a verdict in the international arena must be recognizable,
00:03:53and in order for it to be recognizable,
00:03:57the trial process must be conducted
00:04:00legally, precisely, and with all
00:04:02Bab al-Mandeb to Iraq, from possible formalities. This time interval
00:04:06that we see is an interval that is divided into several
00:04:09important matters. One is the preparation of the case,
00:04:13the documentation of the case, obtaining powers of attorney,
00:04:16preparing petitions and lawsuits.
00:04:19In continuation of the matter, there is the initial investigation of the case,
00:04:23referrals and carrying out expert activities.
00:04:26After that, the process of notification to the foreign party.
00:04:31Because we generally have defendants in this case who are officials,
00:04:34authorities, agencies,
00:04:38are in the hands of our brothers in Iran. This and various sectors of foreign governments, naturally, the process
00:04:42of notifying these individuals and summoning them to the hearing session
00:04:45is a process that must be carried out legally. It must have at least three months
00:04:49for the notification period so that
00:04:52the hearing session is held in a completely legal manner.
00:04:55This is a very important point, you see.
00:05:00caused any Some people might say that can we try
00:05:02another country in a domestic court? Can we issue a conviction
00:05:06against, for example, the president
00:05:09the strongest surprise this of another country in our own domestic court?
00:05:11Yes, according to the laws, both in our domestic custom and
00:05:15in international custom, and in all countries, this rule exists.
00:05:19The important thing is that a specific
00:05:22law must exist regarding this jurisdiction,
00:05:26and secondly, that the trial must be conducted
00:05:29with all the formalities of that law or related laws.
00:05:33We have five main jurisdictional pillars in our existing
00:05:36laws. Based on these five main pillars, the court
00:05:40finds its special jurisdiction. And, of course, the process
00:05:44continues. What we see regarding the time of the crime and
00:05:48the time of the session is that this time span is due to the matters
00:05:51you mentioned, so that the matter can proceed in this manner.
00:05:55Various issues are naturally being addressed
00:05:58regarding this matter. Attacks on things like
00:06:02the glass building of IRIB, like the country's nuclear
00:06:05facilities, the martyrdom of some nuclear scientists
00:06:09and also some of your esteemed and honored family, these are all
00:06:12related to the 12-day war. The 40-day war
00:06:16and the Ramadan war that we have gone through and, of course, are not yet
00:06:19over, essentially a process like this
00:06:22process, which we might call long, but from your perspective is completely
00:06:26legal, the hearing session. Yes, God willing,
00:06:29you will review it. You held the first session.
00:06:33What were the prominent points raised in the session? Look, the discussions
00:06:37surrounding this issue, I will say it generally, look, when
00:06:40we talk about damages related to legal claims
00:06:44of war, the first discussion is that this lawsuit and this hearing
00:06:47that has been held are civil lawsuits and claims for civil
00:06:51damages of war. Discussions related to crimes
00:06:55and criminal matters are still open for review,
00:06:59and are currently being sent to the criminal courts of Tehran, and
00:07:02also, well, it was an important case that we exactly one day before
00:07:06the start of the Ramadan war in international courts
00:07:10and in the Iran-US Claims Tribunal. It was raised. So, in another opportunity,
00:07:13war crimes will be investigated in several
00:07:17multiple opportunities. This means that the discussions we have are about
00:07:20international proceedings, foreign proceedings,
00:07:23domestic proceedings. This means that in the international part, it relates to what
00:07:27we refer to as war crimes. Look, in the discussion of
00:07:31war crimes, which of these sections you mentioned, which of these areas
00:07:34of damage fall within this area and this field
00:07:38of work? Look, considering that every type
00:07:42of attack, every type of aggression entails different dimensions
00:07:45of damage, we have direct damages, meaning the exact damages
00:07:48that, for example, were inflicted on the glass building of IRIB.
00:07:52Well, the number of damages
00:07:55related to the Ramadan war is completely clear. The number related
00:07:59to the 12-day war is also determined, expertly assessed, and done. Now,
00:08:03look, in continuation of the matter, we have
00:08:06suffered direct material damage. We also have a lot of moral
00:08:10damages regarding this issue.
00:08:13In continuation of this matter, we also have multiple
00:08:16punitive damages. Well, you know, for example, regarding
00:08:19the glass building of IRIB, we had a figure for the
00:08:23building, a figure for the equipment, a figure
00:08:26for the technology, and a figure for the value of the lost
00:08:30IRIB archive. Well, all of these were assessed,
00:08:33their number was determined, and it was announced. Now, considering that it is sensitive data,
00:08:37we generally might not be able to announce it in numbers and figures.
00:08:40Those are media regulations, I don't know.
00:09:12Naturally, it has caused destructive effects on the country's industry,
00:09:16the country's technology, the country's scientific findings, and also the country's
00:09:20scientific path, which are by no means cases that can be
00:09:23overlooked or forgiven, and generally, these cases are pursued
00:09:27very diligently, and from the very first day, that is,
00:09:30exactly upon impact, the discussion regarding legal pursuit of this
00:09:34matter began, a case was opened, and the case, with
00:09:38a very, very complete set of documents in
00:09:41various sections,
00:09:58open the topic. You also mentioned the perpetrators in this case, and we are
00:10:01actually charging them.
00:10:05They are the US and the Zionist regime. None of them are members
00:10:09of the Rome Statute either. The point is that an
00:10:12international civil court that is being established in Tehran, based
00:10:16on which of the international statutes and conventions, can enter
00:10:20this matter and investigate and review this matter,
00:10:23and in what dimensions can the case be examined, and how can
00:10:27its evidence be discussed in international forums, and for example,
00:10:30how can we study them so that we can prove
00:10:34this accusation against them that they are guilty
00:10:38and criminals, and for this crime,
00:10:42they must eventually endure a punishment? Where should this be communicated
00:10:45to them? How will the guarantee of its execution be?
00:10:49Excellent. First of all, I am very grateful that this
00:10:52issue was finally given special emphasis, because
00:10:56very often, whether in other fields or other areas, when we talk about international
00:10:59litigation, this angle is exactly the angle that is ambiguous
00:11:03for many people, and perhaps clarifying this is more important than many other matters.
00:11:07And the point is, look, firstly, we have many
00:11:11conventions, treaties, and matters related to international
00:11:14law. Some of these relate to the jurisdiction
00:11:17and competence of courts in the area of proceedings. Some of
00:11:21these relate to the definition and explanation of, for example, a specific type of crime
00:11:25or the prohibition of a specific type of crime. Look, the point
00:11:29is that both of these criminals
00:11:32you mentioned, considering their records, considering
00:11:36their ideologies, considering everything they had in mind,
00:11:40are generally not members of any international treaties
00:11:43regarding trials, and well, generally, wherever there
00:11:47was membership or accession, it was with a reservation
00:11:50of impossibility of proceedings. In many cases,
00:11:54they also had an entry. But eventually, an exit occurred. Now, because we don't want it to become too
00:11:57technical, in this way, look, the point is
00:12:01that we have three types of litigation.
00:12:04We have domestic litigation regarding international affairs.
00:12:07We have foreign litigation and international litigation.
00:12:11Generally, these countries are not members of any
00:12:14international bodies for international litigation to even apply.
00:12:18We enter the discussion of
00:12:22foreign litigation, meaning filing lawsuits
00:12:26in countries that have international jurisdiction
00:12:29and can investigate these countries and these crimes.
00:12:32Indeed, many countries have joined us. Lawsuits
00:12:36have been filed, follow-up is ongoing, and it is progressing
00:12:39with its details. I must also say that our international
00:12:43proceedings are proceeding
00:12:46with power and strength, especially regarding crimes
00:12:49that the whole world agrees are crimes.
00:12:53No one, for example, when we talk about the Minap case,
00:12:57no human, no honorable person
00:13:00in the world, would question that this is a crime. But
00:13:04regarding what we have in the International Civil Branch of Tehran,
00:13:08look, based on the rules of international law, we
00:13:11must have a legal and recognizable verdict. This
00:13:15verdict is issued in a domestic court and recognized
00:13:19in international courts. This means that we
00:13:23then request recognition and enforcement in other countries. Let me say this point:
00:13:26your documentation is complete, you present them, and they
00:13:30are recognized. We have a history of enforcement, a history of enforcement. This means that in
00:13:33numerous cases in this past year alone,
00:13:37previous rulings against the US government have been issued,
00:13:41recognized, enforced, and
00:13:44collected. This means that in recent months,
00:13:47we have had cases where amounts were collected. Ships
00:13:51belonging to the United States were seized in the
00:13:55Persian Gulf. Not only were they seized, but
00:13:58after seizure, our judicial rulings existed. Regarding judicial rulings,
00:14:02an auction was held, sales took place,
00:14:05international sales, in fact. By our order, property
00:14:09belonging to the US that was under our seizure was bought
00:14:13by other countries based on that. This money
00:14:15was deposited into the account of the Iranian judiciary and also presented
00:14:19to the victims of the crime. So this is possible,
00:14:22it is possible and has been done before. It has been done,
00:14:26and this is a very important point, as you also mentioned. Perhaps many of our
00:14:29viewers also have this question, especially regarding when we say
00:14:33our defendant is a foreign defendant and we don't have specific access to them,
00:14:37how can we bring this to a conclusion that, after all,
00:14:41we have suffered some damage? Now, this damage is not physical, this damage is financial,
00:14:44and of course, the details of the points you also mentioned. I just want to interject
00:14:48here, perhaps this is the right place for me to once again
00:14:51invite all people
00:14:55to join the legal battle. All dear ones, this submission
00:14:58of lawsuits, this submission of power of attorney, in the national legal battle system,
00:15:02people should definitely take this seriously, pursue this diligently
00:15:06so that we naturally have a much
00:15:09stronger backing day by day and can pursue this path with strength.
00:15:13God willing, in the first
00:15:16special court for the 12-day war that was held, of course, since this court was special for the 12-day
00:15:20war, and one of the events that happened in the 12-day war
00:15:23was the attack on the glass building, certainly this
00:15:27session was also dedicated to the attack on
00:15:30the IRIB building and they described
00:15:34it as a crime against civilians.
00:15:38In international law, if you agree, please open this up for us and our esteemed
00:15:41viewers and explain the exact difference
00:15:45between a military target and a civilian target, which we have repeatedly
00:15:48mentioned in the news and used this term,
00:15:52but perhaps you, as a legal expert, can better
00:15:56explain its specific examples. Please tell us what it is, especially
00:16:00regarding the media. You say what differences does this military target
00:16:03have with a civilian target? Look, the main discussion is related
00:16:09to international rulings and conventions. You mentioned that in
00:16:12very numerous international conventions,
00:16:16the rules related to war itself are defined:
00:16:19that civilians should not be attacked in war,
00:16:23civilian places, especially cultural
00:16:26places, social places, places where people
00:16:30during wartime need to receive
00:16:33information. People are anxious during
00:16:36wartime. In international law, we have protection of media institutions
00:16:40in a special, specific, and clear manner. Completely. Look, we have a whole
00:16:43set of laws, regulations, and treaties regarding the field
00:16:47of media. Some of these are related to the duties of
00:16:51media outlets themselves, that media outlets should not spread hatred,
00:16:54should not promote violence, should not promote war,
00:16:58and so on. Well, we see that many
00:17:00foreign media outlets, human foreign media outlets,
00:17:04have very specific interventions.
00:17:07They have carried out activities in our sovereign domain which are under investigation. Previously,
00:17:11there has also been a history of investigations leading to the condemnation of many of these
00:17:14now seemingly foreign media networks.
00:17:17For example, regarding attacks on media outlets, look, media
00:17:21outlets, given that people's access to information during wartime
00:17:25becomes more limited, many times communication means might
00:17:28decrease, from the minimum, such as radio and television,
00:17:32and after that, social media, the internet, and so on, people
00:17:35want to use them. Given that people generally
00:17:39need to receive all kinds of health, pharmaceutical,
00:17:43medical, military, and war information through this channel,
00:17:46attacking these is not attacking a building.
00:17:50Attacking these is attacking the primary
00:17:53rights of all people who are the audience of that media
00:17:57outlet. And this is a very important aspect. This means that when
00:18:00an announcement is to be issued somewhere, a topic is to be discussed,
00:18:04educational materials are to be conveyed to the people. Even
00:18:08the media has the duty to soothe the people's pains,
00:18:11to provide war-related information.
00:18:14Well, we see that exactly such
00:18:17a matter was violated in the war. This attack took
00:18:20place. Then, look, regarding all these matters, we
00:18:24have specific rules. First of all, the attack must be justified,
00:18:27it must be on a military target. A military
00:18:30target even differs from a law enforcement target.
00:18:34We now have a report that Human Rights Watch
00:18:37has issued, the Human Rights Commission has issued, even
00:18:41all the attacks that were carried out on our police
00:18:44stations, on our Basij bases, were also condemned.
00:18:47In all of these, it was declared that these are not considered
00:18:50military locations. Military locations
00:18:53are those that are involved in the war itself and in cross-border
00:18:57activities, not in providing internal order. When
00:19:00we have even in the domestic sphere damaged buildings,
00:19:04collapsed buildings, there is a lot of potential
00:19:07for theft and robbery. It is these police stations that
00:19:11must carry out their duties. Evin Prison in the 12-day war
00:19:14also exemplifies this non-military issue. Exactly, it's completely the same.
00:19:18Especially since, you see, in that prison, we had
00:19:21many martyred soldiers,
00:19:24many martyred prisoners, many martyred
00:19:27judges, whereas, you see, judges
00:19:31and places related to providing
00:19:35judicial services to the people are among the cases for which we actually have special rules regarding
00:19:39this matter. And the discussion about IRIB, look,
00:19:42the first rule that must be observed in wartime attacks is the rule
00:19:46of distinction, meaning distinction between military and non-military
00:19:49locations. Even in places where we have military
00:19:53locations in close proximity to civilian
00:19:56locations, the principle of proportionality also applies, meaning
00:20:00the amount of ammunition used must be proportionate
00:20:03to the target. Not that we destroy a target for a specific reason
00:20:07with such ammunition that a very
00:20:10wide radius of unrelated people in that area are hit
00:20:14and destroyed. And well, generally, when these people
00:20:17claim that we are carrying out our attacks,
00:20:21for example, with complete information and data, which
00:20:24certainly was not the case, it was so error-prone, so
00:20:27mistaken, so indiscriminate in many cases, that if I had
00:20:31the opportunity, I would just give you a comprehensive report
00:20:34of the damaged factories in Iran, out of those eleven hundred factories,
00:20:38it would be completely clear that the targets were not
00:20:42military targets, they were not wartime targets. When
00:20:45our country's plastic manufacturing facilities are hit,
00:20:49when the country's disposable roof is hit, this is not a military
00:20:52attack. This is the ugliest type of crime. A wedding in Syria
00:20:56is being discussed. Where is the target military, and what
00:21:00military personnel are present there? Exactly, so we are seeing a chain
00:21:04of destruction that cannot be justified by any logic other than
00:21:07criminal logic, other than the dirty logic that naturally
00:21:11we have probably never seen in any crime in history with such
00:21:15blatant clarity. Since our time is also somewhat limited until the end
00:21:18of the program, it was mentioned in court that
00:21:22separate cases would be opened for each of the
00:21:25raised issues. If you could
00:21:29explain in one minute with what aim this separation
00:21:33is being done, I would be grateful. Look, it is so that we never
00:21:37diminish the magnitude of this crime by combining
00:21:40and speeding up the proceedings. Certainly, just as it does not
00:21:44prolong the proceedings, it does not increase the burden, we will not
00:21:48reach a result late. Look, we should never
00:21:52sacrifice the principle of the result for any speed. Speed is important,
00:21:55seriousness is important, accuracy is important,
00:21:58the ideal perfection is also considered.
00:22:02Certainly, every martyr, every
00:22:04crime, every missile, and every strike is a case.
00:22:08The magnitude of these crimes is never intended to be diminished
00:22:11by consolidation, and certainly, for every crime,
00:22:15every martyr, every destruction, and every impact, we have one
00:22:18case.
00:23:02At these very moments,
00:23:06the prisoners, are arriving. They emerge from the depths of prisons
00:23:09and from the detention centers of the aggressors like fierce
00:23:13lions, with their heads held high and their foreheads bright. Praise be to Allah, Lord of the Worlds, for the safety of these
00:23:16heroic mujahideen. They are now arriving
00:23:20to their families, to their kin, to their relatives, among the members
00:23:24of their people. They emerge steadfast like towering mountains. They have not
00:23:27wavered, nor have they flinched, nor have they weakened, nor
00:23:30have they surrendered, nor have they been enfeebled,
00:23:34despite the harsh treatment and despite the violations and torture
00:23:37by the jailers. Let the world be adorned,
00:23:40let it rejoice, let the people of wisdom
00:23:43and faith come out to receive these heroic prisoners,
00:23:47who emerged by the grace of God Almighty. And by the steadfastness
00:23:51of their mujahideen comrades on the carpet of happiness,
00:23:54secrets whisper, and pride covers Yemen
00:23:58and the Ansar people.
00:24:02on the red carpet, the day
00:24:04we embraced, we conquered the creator of calamity. O
00:24:09first and in the last, and thanks
00:24:12to You for what happened in our sacrifice.
00:24:15Our joy in our exodus
00:24:18with honor beyond
00:24:20challenge.
00:24:25The great power and beneath its chest, the humility
00:24:29of Al-Ghazzani. They met their adversaries
00:24:32defeated, disbelieving
00:24:35his
00:24:37name. You are the ones who force us to fight you. By God
00:24:41Almighty, if if we knew
00:24:44that there was any sense of honor or zeal in you,
00:24:47we would not have fought you from
00:24:52the Arabian Sea to Lebanon, from the Red
00:24:56Sea to Iran, from
00:24:59Djibouti, the border of Yemen with the Yemeni border,
00:25:02to Palestine. I am loyal to the covenant,
00:25:06O axis of pride and steadfastness. We now have, by the grace of God
00:25:09Almighty, two straits: the Strait of
00:25:12Hormuz and the Strait of Bab al-Mandeb. And by the will of God
00:25:15Almighty, the blue entity will not be able to control
00:25:19them, nor will the Saudi enemy, by the will of God Almighty.
00:25:22And today, the keys to Hormuz
00:25:28ship, this is what the enemy used to sing about, that our missiles
00:25:31are ineffective and have no impact.
00:25:34Focus on where it hit. The poet was right when he said
00:25:38we only hit the heart or the skull. There's a skull on the ship,
00:25:42by the grace of God Almighty. These are the ships that the armed forces used to hit,
00:25:45and the people used to come out and say, "You're doing nothing, you haven't
00:25:50damage to the entity." Incinerated, by the grace
00:25:54of God Almighty. Come, I'll show you today
00:25:59week. The result of the results, the summary of everything this week,
00:26:02this is the strongest
00:26:04picture, and this is the strongest shot, and the strongest scene you might see until this moment.
00:26:08Come.
00:26:15O Lord, all praise
00:26:17is due to You.
00:26:20We are officially in Bab al-Mandeb,
00:26:22Yemen. When a person simply dismisses
00:26:26this group, they might make a mistake in calculating
00:26:30their power. But now, more than ever,
00:26:34this truth has become clear to all the people
00:26:37of the world: power belongs to the people
00:26:41who have gathered around the axis of Velayat.
00:26:43It will not be long before the oppressed throughout
00:26:47the world will realize that true power lies
00:26:51only in unity of faith,
00:26:54and there is no way other than armed
00:26:58jihad to achieve justice.
00:27:01Then, the truth inherent
00:27:04in the name of the Mobilization of the Oppressed will be
00:27:07realized, and all the oppressed will
00:27:11put on the attire of battle to fight
00:27:14oppression and will enter
00:27:18the battlefield. God is Great.
00:30:32Let us preserve the greatness and glory of the people's
00:30:36awakening in the streets with sacred cohesion and unity
00:30:39in all domains. General Mousavi, in a message on the eve
00:30:42of the twentieth night,
00:30:46the twentieth night of the Iranian nation's awakening
00:30:50and their presence in squares and streets, considered
00:30:53this nightly uprising a cause of global
00:30:56astonishment and wonder. The Commander of the IRGC Aerospace Force.
