00:04:26Živašnica, Brđani, Džepi, and Džepska Planina, a fire

00:04:33the operational center of civil protection of the Herzegovina-Neretva Canton,
00:04:37the fire has a tendency to spread, which is favored by high temperatures and

00:09:21eventually, it would represent a historic
00:09:25step forward in resolving accumulated
00:09:28problems, stabilizing the Federation as a larger entity, and this would
00:09:32ensure the path to the European Union for both the Federation and
00:09:35the entire Bosnia and Herzegovina. Croatia would then be very
00:09:39helpful to us, as it would be our engine for joining the European
00:09:42Union for accelerated accession, negotiations, what we are not using now with these
00:09:46relations with Croatia is cross-border cooperation and other issues,
00:09:50that is the question of all complex relations that exist, but I think that
00:09:53a turnaround in Bosniak politics is necessary regarding this issue.
00:09:57There is constant talk about the necessity of amending the Election Law of Bosnia and
00:10:00Herzegovina, we also have
00:10:03this, however, constantly, even representatives from the Bosniak people
00:10:07and from the Croatian people say that it should be done,
00:10:11but we don't have concrete
00:10:13steps and moves, why do you think there aren't any, well, I think, I think there aren't any
00:10:17because the existing policies, when I say existing policies that
00:10:20have been in power for, let's say, the last 20 years,
00:10:24this... situation suits them, because in that way they feed on certain
00:10:28fears, so-called fears or real
00:10:32fears, meaning they manipulate their electorate,
00:10:35we have been at a standstill the whole time, I think we have been at a complete
00:10:39standstill since 2006.
00:10:47the Constitutional Court of the Federation of BiH stated in its submitted opinion that
00:10:50local self-government units are obliged to form local
00:10:54communities, as a form of local self-government.
00:10:58What specifically changes now with this decision in Mostar, can we
00:11:01now expect that the city must now enable
00:11:05the actual functioning of local communities, who is responsible
00:11:08for this not having been done so far? Well, responsible is, we are
00:11:12all responsible in the city, but of course those who form the political majority in the city
00:11:16council and who govern the city of Mostar are the most responsible, meaning in the last six years
00:11:20certain initiatives have been launched since we again have a city
00:11:23council, certain initiatives have been launched to establish
00:11:26local self-government, meaning we have local communities in
00:11:30the city of Mostar, but in these local communities local
00:11:34self-government is not realized, what the Law on
00:11:37Principles of Local Self-Government in the Federation mandates, meaning
00:11:41we had some small initiatives, let's say to form a new
00:11:45network of local communities, to organize elections for these local
00:11:48communities as in other local self-government units, but
00:11:51uh for all that we need a change of the statute, we haven't... implemented even
00:11:55the decision of the Constitutional Court, or rather only partially implemented the decision
00:11:59of the Constitutional Court regarding Mostar, and I think in the next
00:12:02period, besides that part of this opinion
00:12:06of the Constitutional Court which referred us to
00:12:10the necessity of implementing the statute, we have another opinion
00:12:13also and I think that in some next
00:12:16period, not before these elections, but after the elections, the time will come
00:12:20to seriously sit down to discuss appropriate amendments to
00:12:24the statute to align it with the Federation Constitution and the Constitution of Bosnia and Herzegovina. And
00:12:27how many, well, necessary amendments to the statute? What all needs to be
00:12:31changed in the statute? Well, look, we have what is obligatory by the
00:12:35Constitutional Court to implement a part regarding the decision-making process in
00:12:38the central zone, that is, the use of financial
00:12:42resources, which is decided by councilors who are elected from
00:12:45urban areas. That issue remained
00:12:49unresolved in the decision of the Constitutional Court, and only
00:12:52the issue of holding elections in the city of Mostar was resolved, meaning
00:12:56we have a situation where we must ensure
00:12:59changes, changes regarding local communities,
00:13:02their establishment, functioning, that is, ensuring local
00:13:06self-government for all citizens in the city, the second part concerning
00:13:09the new opinion of the Constitutional Court, meaning it's an opinion, not a decision, it
00:13:13didn't annul certain provisions of Mostar's statute, that is
00:13:16for ensuring the candidacy of others, I
00:13:20wanted to mention that, others, others in the city, in the city
00:13:23of Mostar, because the current city statute of Mostar, which we must say
00:13:26was imposed by the High Representative then,
00:13:30Paddy Ashdown, did not foresee the possibility for the club
00:13:33of others to nominate the vice president and president of the city
00:13:36council, do you expect that these changes will occur, that
00:13:40this clause will be included, well, look, we will, we will implement those changes
00:13:44if we are responsible, if we have such an opinion of the Constitutional Court
00:13:47uh embed, such issues are resolved at certain

00:14:06have full political will to resolve all these
00:14:10issues, you said that it's resolved when it comes to elections
00:14:14in the city of Mostar itself, however, does the current statute
00:14:17of the city become an obstacle to the normal
00:14:20functioning of Mostar, what would a statute that you and
00:14:24HRS would propose look like? Well, look, there is
00:14:26that statute, as we've already said, it was imposed by
00:14:29the administration, that is, the High Representative,
00:14:33he abolished the previous six municipalities and the city structure
00:14:36that previously existed, replacing it with a unified city administration, we
00:14:40then from the beginning with that statute got a unitary
00:14:44organization of the city, we have five departments in the city,
00:14:48the opinions that are appearing are that we should make
00:14:50a reorganization of the city administration, we believe that we
00:14:54should, uh, should regulate a number of issues
00:14:57regarding the method
00:14:59of appointment, receiving people, meaning, well, and fulfilling
00:15:03constitutional competencies, meaning everything that should be is something
00:15:07that necessarily requires and at all times changes in legislation at
00:15:10higher levels and we have an obligation to harmonize with them,
00:15:14but we first need to adopt this statute that was imposed by
00:15:18the High Representative, meaning then change it,
00:15:21meaning it is still with us, let's say, on a temporary basis. And
00:15:25what about the possible return of city municipalities, are you
00:15:28for that? Well, look, there is a proposal, meaning we always have some
00:15:32emissaries, well, specifically in this case it was Mr. Efendić who came to Sarajevo,
00:15:35allegedly concerned about the status of Bosniaks in the city of Mostar,
00:15:39and he proposed the return, the return of city municipalities, that is,
00:15:42a return to the situation before 2004,
00:15:45meaning we have situations in cities of Bosnia and Herzegovina like Sarajevo, well,
00:15:49specifically Sarajevo, which has a regulated issue, has city municipalities, has
00:15:53a city, has a city as an institution with very small
00:15:56powers, uh, in principle, if we are all in the majority
00:15:59for it, even if it's a good model, I could talk about it to see what the
00:16:03competencies would be, we from HRS would discuss what the competencies would be, but it would be
00:16:07necessary then to apply that model, if it's good for Mostar, I don't see any reason why it
00:16:11shouldn't be applied to other municipalities in the Federation,
00:16:14for example Travnik or something similar, one, one
00:16:18of the actually bigger problems are actually public enterprises in
00:16:22the city of Mostar, in recent times the most current are somehow
00:16:25the Uborak landfill and Komunalno, you spoke
00:16:29about serious suspicions regarding the work and management
00:16:33of Komunalno, are there certain proofs, do you actually
00:16:36expect that there will be... an investigation regarding the work and management of
00:16:40the public enterprise Komunalno in Mostar? Well, look, in the city of Mostar,
00:16:44in the city of Mostar we have stipulated in that statute a department
00:16:47for internal supervision, it was until half a year ago
00:16:51unfilled for six or seven years, one of the powers of that
00:16:54department for internal supervision was to oversee the work of these public
00:16:58enterprises, you know, what we
00:17:01are witnesses to, we are witnesses that these public enterprises, that
00:17:05these public enterprises in the city of Mostar for example had a fire at
00:17:08the landfill, at the Uborak landfill where according to initial estimates the damage
00:17:12is 20 million marks, we are talking about material damages, damages
00:17:16that occurred to the health of citizens due to that disaster are
00:17:19unfortunately immeasurable, they will be seen in the
00:17:22future, we currently have an unresolved situation with that
00:17:25enterprise, in the public utility enterprise we have major problems,
00:17:29major problems with the way it operates and is managed, we are witnesses that
00:17:33a series of criminal charges have been filed these
00:17:36last few days due to abuses in this
00:17:38enterprise, and at the current council session we witnessed that
00:17:42certain councilors accused each other that funds
00:17:46and resources, that is, resources or
00:17:49or or or equipment of that enterprise, were used for certain
00:17:53councilors or political officials to pave their
00:17:56yards, courtyards, meaning that is, that is something

00:18:59the management and operation of the public utility
00:19:03company itself, you spoke and said that there are two
00:19:06utilities under the same roof, do public
00:19:09enterprises in Mostar divide along national
00:19:12political lines, who does it, why, how long would it actually
00:19:16take now to start recovering the system, how long would it
00:19:20take primarily to uncover all these
00:19:22possible malversations, frauds, divisions, and only then
00:19:26to actually recover everything and establish it as it should be? Well, look,
00:19:30it is clear that these companies of ours did not function in accordance with
00:19:33the law, that is, the law on public companies and the law on economic
00:19:37companies which they are obligated to
00:19:40apply, we are witnesses that the managements of these companies that were
00:19:44appointed had a sharp division of competencies
00:19:48regarding, to be completely honest, regarding
00:19:51the implementation of the activities of these companies in certain urban
00:19:54areas, both with a Croatian and a Bosniak majority, meaning we
00:19:58don't need to hide that, it's clear to everyone, we have a situation where in certain
00:20:02companies "working units" were formed, I call them that,
00:20:05working units one and two
00:20:08which were essentially formed from former separate companies during the merger,
00:20:12so the citizens and these companies still have not fully functioned
00:20:15in, functioned, been in that common,
00:20:19common form, meaning because of that we have chaos
00:20:22in that management, we have been witnesses for many years
00:20:26and also through citizen reports, public announcements that funds, specifically
00:20:29machines, excavators, backhoes of these public companies
00:20:33not only... outside working hours, are found
00:20:36in private, are found in the area, are found in the area of other municipalities, people
00:20:39filmed them, published them, meaning huge abuses,
00:20:43there is huge suspicion of abuses, mhm,
00:20:46and well we will see what will be the subject
00:20:50of those investigations, whether the prosecution, I don't see
00:20:53any reason for delay there, these are not some cases in
00:20:57which huge investigative actions need to be carried out,
00:21:01you know and what is necessary in all these
00:21:04companies is to conduct an independent audit of operations, if
00:21:08possible, we advocate for an international audit, we know that
00:21:12it costs a lot, but I think a cross-section needs to be made,
00:21:15how do you then view these recent dismissals
00:21:19that we witnessed in Komunalno, are these dismissals
00:21:23of workers a consequence of economic and organizational
00:21:26problems that certainly exist or precisely political and national
00:21:30relations within the company, we now see
00:21:33workers talking about pressures they
00:21:36suffered, how do you view this entire situation now? Well, look, we were,
00:21:42which no one wanted to publish that alleged petition, let's say, of workers
00:21:46who refuse to work from allegedly
00:21:48working unit two, but stop working in the area of working
00:21:52unit one or vice versa, to be clear,
00:21:55in the area where Croats mostly live or in the area where Bosniaks
00:21:59mostly live, meaning we have workers who refused
00:22:02to work, allegedly, again, we're talking about that part of fulfilling
00:22:06their tasks, uh
00:22:09which they are obliged to do throughout the city, and
00:22:12they have the right to choose where they will work, that is impossible,
00:22:16it shows a multi-layeredness in the management of these
00:22:20companies, meaning these companies were not merged in
00:22:24a proper way, when we merged we
00:22:27warned that it might not be best in that way,
00:22:31it was proposed to form a holding company to know exactly in a
00:22:35holding company there would be more companies, landfill,
00:22:38cleanliness, waste collection, execution of works, to be
00:22:41controlled through a common holding company, there were more proposals, unfortunately it seems
00:22:45that the worst was chosen and it does not function today, it is obvious
00:22:49that in this whole process there was manipulation of workers, mhm,
00:22:53absolute manipulation, certain people stated that they didn't know what they
00:22:56signed in that petition, you didn't even see the
00:23:00petition, uh, we saw a letter, but
00:23:03I personally didn't see a signed petition, it wasn't presented, also
00:23:07we didn't see any decision about termination of employment
00:23:10contract for what reason some worker
00:23:13was given that notice, well, specifically I am a lawyer so
00:23:16I cannot evaluate if that decision, let's say, at least... for formal
00:23:20legal reasons is lawful or not, but it is very, well,
00:23:24evident now the supervisory board as
00:23:26a second-instance body is resolving the appeals of those
00:23:29workers, that is, requests for review of those decisions, and
00:23:33I, as I may have heard from the media, have even heard that some decisions were
00:23:36adopted, yes, but well, what can the city
00:23:40council do now, what can you order the public
00:23:43company to do, can we perhaps
00:23:46expect, uh, well, an audit again,
00:23:50some new establishment of a different kind, a different
00:23:53way of working in the municipal company, so what we
00:23:57witness, means that these public companies that we have, not only in the city of
00:24:01Mostar, but at higher levels or other cities are in huge problems,
00:24:05mhm, we witness that maybe some companies that have entered into
00:24:08public-private partnership with private companies in some municipalities have much fewer
00:24:12problems, maybe it costs a little more,
00:24:16maybe it looks a little different, but obviously we need new... in question

00:24:23regulating these issues, but what is worrying is that all these
00:24:27companies operate, have poor business
00:24:30results, meaning not only in the city of Mostar, look,
00:24:34look at the list of tax debtors at the federation level, and you will

00:24:42the indirect taxation administration, which public utility companies
00:24:45are the biggest debtors, meaning that contributions are not paid,
00:24:49that... VAT is not paid, at the same time, these companies, unlike
00:24:53private companies, are not blocked by the tax administration, so
00:24:56that one chaos,
00:24:59be resolved,
00:25:02uh, we are witnesses that in some other municipalities there were bankruptcies of public utility companies,
00:25:06establishment of new ones, I don't know what the future of the city is in the city of
00:25:10Mostar, we have a difficult situation at the landfill which burned down, we have
00:25:13workers currently working on disposing, discarding,
00:25:17sorting that waste that is there... it comes from I think there are
00:25:21about 55 workers, uh,
00:25:23they have a very difficult situation, all this concern
00:25:27for these layoffs prompted me in a way to ask myself how no one takes care
00:25:31of those 55 people who did these jobs whose future is
00:25:35uncertain, we hope that these people will fit into other
00:25:38other city public utility
00:25:41companies, that they will remain at that landfill for guarding
00:25:44and disposal
00:25:49that landfill. That is all that awaits us in the next period
00:25:57public utilities and that problem with waste disposal,

00:30:24similar state, is it even possible then to come and
00:30:28solve these problems? Well, it is possible to solve these problems, but these problems
00:30:31will not be solved until Bosnia and Herzegovina joins the European
00:30:34Union, mhm, I'm afraid they won't be solved, the moment we
00:30:38will not only have our prosecutor's offices, but European prosecutor's offices, we are witnesses now in
