00:17:53through how the decision to suspend
00:17:57the FCC, ABC's affiliate stations, and its
00:18:00parent company Disney. And he speaks to leading First Amendment
00:18:04scholars about the direction we're heading when it comes to free speech.

00:18:29Conservative activist Charlie Kirk, only 31 years
00:18:32old, has been killed after being shot in the neck in an
00:18:36apparent assassination. From Utah to Arizona, New York, and

00:18:45What does the Charlie Kirk murder say,
00:18:49if anything, about the state of free speech in America and the state
00:18:52of free speech on college campuses? It's a scary moment
00:18:56for those of us who have always explained that speech is not violence. Speech
00:18:59is the best cure for violence ever invented. So a lot of us were
00:19:03just genuinely horrified, even those of us who are critical of Charlie for any number of
00:19:06reasons, that someone should get killed for going to argue with
00:19:10students on campus.
00:19:14The attack on Charlie Kirk came amidst years of concerns over
00:19:18suppressed speech on college campuses. Many see his
00:19:21tragic killing as a watershed moment, and it pushed
00:19:24beyond universities. People from all walks of life,
00:19:28politicians, celebrities, expressed their sadness,
00:19:31including this sentiment from Jimmy Kimmel on September 11th,
00:19:35the day after Kirk's horrific murder. Like the rest of the
00:19:38country, we're still trying to wrap our heads around the senseless
00:19:41murder of the popular podcaster and conservative
00:19:44activist Charlie Kirk yesterday, whose death has amplified our
00:19:48anger, our differences, and I've seen a lot of
00:19:51extraordinarily vile
00:19:54the political spectrum. Some people are cheering this, which is
00:19:58something I won't ever understand. The fallout from
00:20:01Charlie Kirk's killing has spread to the workplace. These companies and
00:20:05organizations have reported either terminated or suspending employees for posts
00:20:09about Kirk. I went on social media and I saw a
00:20:12video of a student in Texas
00:20:15making fun of Charlie Kirk being murdered. I didn't
00:20:19like it. I could see why people would be offended by it. Within the day, I believe,
00:20:23the governor of Texas was weighing in on
00:20:27this student's speech, yeah, and saying he had
00:20:30been expelled. Yeah, there was so
00:20:34much emotional opportunity to go after a political enemy
00:20:38that they just kind of leapt on it. Many politicians on the right, when it comes to somebody saying
00:20:42this person should not have their job because of their speech, is there a
00:20:45difference between the government doing it and other people
00:20:49doing it? Cancel culture, and just to be clear, it does come from the
00:20:52right and left and always has. But when you're talking about actual
00:20:56official government pressure to punish someone, that's just good old-fashioned
00:21:00authoritarian censorship.
00:21:03And on the night of Monday, September 15th, this moment on Jimmy
00:21:07Kimmel Live seems to have caught the attention of the U.S.
00:21:10government. We had some new lows over the weekend with
00:21:14the MAGA gang desperately trying to characterize this kid who
00:21:18murdered Charlie Kirk as anything other than one of them and doing everything they
00:21:21can to score political points from it. In between the
00:21:24finger-pointing, there was grieving. This aired several
00:21:28hours before the Utah County Attorney's office
00:21:31filed formal charges against Utah native Tyler
00:21:34Robinson. In those charging documents, more details
00:21:38emerged about the alleged killer and his possible
00:21:41motive. Kimmel went to make light of the president and
00:21:45his reaction.
00:21:47On Friday, the White House flew the flags at half-mast, which got some
00:21:50criticism. But on a human level, you can see how
00:21:54hard the president is taking this. My
00:21:56condolences.
00:21:59Sir, personally, how are you holding up over the last day and a half, sir?
00:22:03I think very good. And by the way, right there, you see all the trucks. They've
00:22:07just started construction of the new ballroom for the White House,
00:22:10which is something they've been trying to get, as you know, for about 150
00:22:14years. And it's going to be a beauty.
00:22:17Yes, he's at the fourth stage of

00:23:04network television. TV shows get canceled all the
00:23:08time, but usually the tension is only between the stars
00:23:11and the producers versus the network or the distributor. This time there
00:23:15was a third party, the government. This Kimmel story
00:23:19was different. The government pressure and a reflection. In the
00:23:22last couple of days, here's the moment that changed the conversation. You
00:23:26when you look at the conduct that has taken place by Jimmy
00:23:30Kimmel, um, it appears to be
00:23:33some of the sickest conduct
00:23:37possible. This is Federal Communications Commission chairman
00:23:40Brendon Carr on the Benny Show podcast, a
00:23:44pro-MAGA podcast, two days after Kimmel's controversial
00:23:47comment. Frankly, when you see stuff like this, I mean, look, we
00:23:51can do this the easy way or the hard way. These companies can
00:23:54find ways to change conduct and take action
00:23:58frankly on Kimmel, or there's going to be
00:24:01additional work for the FCC ahead. It's hard to think
00:24:05of a clearer example of the government crossing that line into
00:24:08coercion than when Brandon Carr says, "We can do this the easy way or the hard
00:24:12way." That's a textbook example of what the courts have
00:24:16said would violate the First Amendment. There are actions that we
00:24:19can take on licensed broadcasters, and frankly, I think that it's it's it's
00:24:24these licensed broadcasters themselves push
00:24:27back on Comcast and Disney and say, "Listen, we are going to preempt. We're not going
00:24:31to run Kimmel anymore until you
00:24:34straighten this out, because we, we licensed broadcasters, are
00:24:38running the possibility of fines or license revocation from the
00:24:41FCC if we continue to run content that ends up being
00:24:45a pattern of news distortion." It's time for them to
00:24:48step up and say this garbage, to the extent
00:24:52that that's what comes down the pipe in the future, isn't something that we think
00:24:55serves the needs of our local communities. But because I've spent
00:24:58so much time myself studying FCC policy over
00:25:02the years, I knew immediately that that had to do with
00:25:05whether the FCC would investigate these
00:25:08stations for proper conduct, which the FCC is
00:25:11allowed to do, what that implies is if these stations aren't
00:25:15properly serving the public interest in their communities now
00:25:19being defined, by chairman Carr of the FCC as something very
00:25:22specific about how they treat President Trump, then they might have
00:25:26to worry about their television station licenses. There's no one in the
00:25:30television business that did not hear it that way.
00:25:34How broadcast television works is you have these big national
00:25:37networks, ABC, CBS and NBC, they
00:25:40rely on deals they have with stations all around the
00:25:44country, and these stations are what carry their national programming into
00:25:47every nook and cranny of the country.
00:25:50Those television stations are licensed by the
00:25:53government.
00:25:56The same day, Chairman Carr spoke on that podcast, Domino's started to
00:26:00fall a shocking clip.
00:26:03"The FCC chair suggested that his agency may revoke affiliate
00:26:06licenses and hours later, two broadcast groups had announced that they would
00:26:10preempt or pull Kimmel's show from 62 TV markets or

00:27:36action, companies pick up their ears and they might
00:27:40act. Yeah, they want to curry favor with the FCC,
00:27:43they want to be on their good side.
00:27:47After the local stations decided to boycott Jimmy Kimmel Live,
00:27:51ABC Network and its parent company Disney soon
00:27:54followed. The breaking news, ABC, the network
00:27:58pulling Jimmy Kimmel from the air, a network spokesperson saying
00:28:01simply, Jimmy Kimmel Live will be preempted
00:28:04indefinitely. Just moments ago, the administration's rapid
00:28:07response media team posted this online which
00:28:11reads they're doing their viewers a favor. Jimmy is a sick
00:28:15freak. CNN chief media analyst Brian Stelter. You
00:28:18reached out to the FCC Chairman Carr. What did
00:28:22he tell you? And he sent me the gift that we will put on
00:28:25screen, Anderson. It's a picture from the old NBC

00:29:20example, I read someplace that the networks were
00:29:2397% against me. I get 97%
00:29:27negative, and if they're 97%
00:29:31against, they give me only bad public or
00:29:34press, mean they're getting a license.
00:29:38I would think maybe their license should be taken
00:29:42away. It will be up to Brendon Carr.
00:29:45If you notice there, the President just segued from comedy he doesn't like
00:29:49to network news he doesn't like. Do you
00:29:52think that Brendon Carr as chair of the FCC has weaponized the
00:29:56FCC? I think this administration is weaponizing every
00:30:00agency it has under its power right now, and it has
00:30:03asserted that even though the FCC is an independent agency, that
00:30:07it has to do its will, and so we are using
00:30:11our leverage over private companies to do this
00:30:15administration's will.
00:30:18How serious an offense against the First Amendment do you think it is what happened to
00:30:22Jimmy Kimmel? I can't think of anything where a government was
00:30:26more directly and openly threatening. Yeah, one of the things that I
00:30:29found so remarkable about the whole Jimmy Kimmel thing, was
00:30:35the FCC was, how up front Trump himself was, saying that it's the
00:30:38stated goal of my administration to get rid of
00:30:42late-night comedians. That I'm not familiar
00:30:45with in American history. Um, there have been
00:30:48presidents to be clear who are not good on freedom of speech, they tended
00:30:52not to brag about it though, or if there were fingerprints you didn't see
00:30:56them. Yeah, that's one of the fascinating things about the Trump administration.
