00:20:51hates us? Why haven't the verdicts of international domestic courts
00:20:55concerning war crimes and for which thousands
00:20:59of documents remain, which are an incredible depiction of what human
00:21:02beings are capable of to harm other human
00:21:05beings, not at all changed the entrenched
00:21:08regional positions regarding their pasts? Among other things, I am discussing

00:21:51it said that this verdict does not deal with the fairness
00:21:55of the KLA's fight against Serbia
00:21:58in some general sense, but that it
00:22:01deals only with specific crimes for which those accused were
00:22:05charged, namely
00:22:08unjust detention, abuse, and murder of hundreds
00:22:11of people. What the court established beyond a reasonable
00:22:14doubt will not disrupt the views that people in
00:22:18Kosovo have adopted on all these issues, where they view all of this in a very absolute
00:22:21way and reject any findings of fact that do not match
00:22:25their preconceptions. So, what would you say, let's ask this follow-up
00:22:29question: does this verdict, contextually
00:22:32speaking, have greater
00:22:35political, judicial, just, or social
00:22:39significance? Well, I don't think these things are in competition. So, the extent of the
00:22:42political or social significance of that verdict depends on
00:22:46what other social actors do with it. If you were to, for example, take a
00:22:50verdict, and have an educational program about schools, about the facts that were
00:22:54established in that verdict, then that verdict
00:22:57would have social significance. If all social elites, political,
00:23:01media, educational, unite against such a
00:23:04verdict, it will be completely marginalized. I mean, that's the complete
00:23:07experience of all international courts from Nuremberg until today, because
00:23:11those verdicts in any country in the region, including our
00:23:15country, in Bosnia, in Croatia, now we have
00:23:18examples in Kosovo, are actually viewed only through that political
00:23:21context, where the people who were convicted before
00:23:25international or domestic courts in this
00:23:28case are essentially even
00:23:31more popular than they were before that verdict. Thaçi
00:23:35has more support now than when he was president or prime minister. That's right,
00:23:38they have, so that glorification of a war
00:23:41criminal as actually another
00:23:44victim. So the fact that a war criminal is prosecuted
00:23:47actually makes him a victim.
00:23:50No one untangles, for example, what the judge read yesterday,
00:23:53uh, what essentially happened to each
00:23:56individual, what conditions they were in, where they
00:23:59relieved themselves, how they were beaten, what
00:24:03injuries they had. Exactly, the victim herself becomes completely
00:24:06irrelevant. So the only thing that matters is the nation or
00:24:10some general narrative about the justice of the struggle. So let's just
00:24:14talk about the verdict itself. So
00:24:17we have a joint criminal enterprise or
00:24:21a joint criminal enterprise, we don't have command
00:24:25responsibility. What does that mean, does it even matter,
00:24:28that is, a joint criminal enterprise is a form
00:24:32of responsibility where you can convict some highly
00:24:36ranked people for criminal acts directly
00:24:39committed by people far down the chain
00:24:42of command, that is, some ordinary guards in some
00:24:46camp. So you can convict highly
00:24:49ranked people based on the fact that they actually had
00:24:52a plan, a common intention to commit certain criminal
00:24:56acts. In this particular case, the court said, Thaçi,

00:27:32various... ways of differentiating those punishments. In
00:27:35this particular case, these sentences that were handed down yesterday are
00:27:39more or less completely in line with the practice of international courts,
00:27:42specifically in the case of Šainović et al which also dealt with Kosovo,
00:27:46so crimes of Serbian forces in Kosovo, all the
00:27:50accused received lesser sentences than those handed down yesterday
00:27:53to Thaci and Krasniqi, so Šainović received 18 years, Pavković received
00:27:5722 years and Thaci and Krasniqi received 25. I mean,
00:28:01that's the relevant comparison. Not what happened in Banjska where
00:28:04the proceedings were conducted before some ordinary domestic court, not before such
00:28:08a hybrid internationalized court. Yes, there was also a debate about
00:28:12there being no uh uh that organ trafficking was not
00:28:16included in the indictment, the Yellow
00:28:18House and so on. Do you have a position on that? So
00:28:22we know from the statements
00:28:25uh of the investigators later
00:28:28the prosecutor that there is
00:28:31no evidence... uh enough to bring, that's what was
00:28:34said, to bring charges. Do you think that's the reason or something else? That's
00:28:37actually, I think, a very complicated question that needs to be explored
00:28:41more deeply. So, two things, two
00:28:44sets of crimes, let's put it that way, were not the subject
00:28:47of this case. The first thing is that whole story about organ
00:28:51trafficking, which actually, if you remember, was the driving force
00:28:55for the establishment of this special court. So
00:28:58that Dick Marty report which then provoked
00:29:02the European Union to, along with other allies, actually impose on
00:29:06Kosovo the establishment of this court, uh that
00:29:09story about human organ trafficking was not
00:29:12the subject of that case at all. Also, the subject of that case was not the ethnic
00:29:16cleansing of Serbs from Kosovo after the war ended,
00:29:20so after the armed conflict was over, and that was June 20,
00:29:231999, then actually most of the crimes that happened
00:29:27against Serbs were committed in that period when Serbian forces withdrew and
00:29:31went into self-defense. "And in those few months, so,
00:29:34about a thousand Serbs died, I mean, in Kosovo,
00:29:37most Serbs were, were now they left then, so,
00:29:41these acts were not the subject of this case at all,
00:29:45but is it, is it understandable or not understandable,
00:29:50look at it, one way which I'm afraid is dominant here
00:29:53uh in Serbia would be the following, that the reason why this case
00:29:57did not mention organ trafficking or the ethnic cleansing of Serbs from Kosovo after the end
00:30:01of the war is some conspiracy. So the West and all those Western
00:30:05judges decided to cover up everything that happened to the Serbs, that
00:30:08is option one, that is the option I don't believe, but I am afraid that is the option that
00:30:12I tell you will in some case become valid, that which
00:30:15you are talking about now after the end of the war could
00:30:18eventually, if it is raised, I assume that this court
00:30:22will not close its doors now, but continue to work
00:30:28investigations, that would be a crime against humanity
00:30:31eventually. That's right, exactly and both
00:30:35issues, i.e. organ trafficking and the ethnic cleansing of Serbs after the end
00:30:38of the war, can be the subject of some future proceedings. We know that
00:30:42this court has not concluded all its proceedings, so a
00:30:45month ago the prosecutor filed a new
00:30:49indictment, the contents of which we do not know, it is still
00:30:52under uh uh confidential, so it is with
