00:01:45Enlargement Marta Kos stated that the specialized chambers

00:06:22That Veselin Milić will be tried before the First Basic
00:06:26Court in Belgrade, was confirmed to me by the First Basic

00:06:33Milić is charged with two criminal offenses,
00:06:36failure to report a criminal offense of a perpetrator, and
00:06:40falsification of an official document. In the case of the murder
00:06:43of Aleksandar Nešović Baja in restaurant 27 in
00:06:47Senjak, which happened on May 12. The indictment
00:06:51against the former head of the Belgrade police was filed by the Higher Public
00:06:55Prosecutor's Office in Belgrade in July this year. By the way, the day

00:07:53the head of the Belgrade police. From the start,
00:07:56the investigation was full of deficiencies. The Higher Public
00:07:59Prosecutor's Office published contradictory and untrue claims
00:08:03in statements that were almost daily. As
00:08:06the direct perpetrator of the murder of Aleksandar Nešović, in
00:08:09Senjak, Saša Vuković, better known as Boske, was identified. He
00:08:13has been in custody since May 14 this year. Nešović's body

00:13:20The leader of the European Serbia list and president of the Serbia Center party
00:13:23Zdravko Ponoš said that he does not see more opposition lists
00:13:27as an obstacle to their participation in the elections, adding that
00:13:31expectations that the student list itself would bring about a change of government without
00:13:34the opposition are unrealistic.
00:13:37The question arises of a referendum atmosphere, why it exists

00:24:54military leadership of our country, and especially against Ratko Mladić, influenced
00:24:58the establishment of the view that everyone is against Serbs, that everyone
00:25:01hates us. Why have the verdicts of international domestic courts
00:25:05concerning war crimes, behind which thousands
00:25:09of documents remain, which are an incredible picture of what
00:25:12human beings are capable of to harm other human
00:25:15beings, not at all changed the ingrained regional
00:25:19positions in relation to their pasts? About this,
00:25:22among other things, I am talking with Professor of the University of

00:25:29Milanović, good morning and good morning and thank you for being here
00:25:32I would like to start, let's start from that
00:25:36context, but in a narrower sense of the word, did this
00:25:39verdict in essence bring
00:25:43the black and white picture of relations or
00:25:47the perception of the citizens of Kosovo regarding
00:25:50their past, that is, regarding the role
00:25:53of the Kosovo Liberation Army, that is, individuals in it? Well, I'm afraid
00:25:57not, I mean, the judicial panel was completely clear at the very beginning
00:26:01of the verdict when it said that the verdict does not deal with
00:26:05the justness of the KLA's fight against Serbia
00:26:08in some general sense, but that it
00:26:11only deals with concrete crimes that the accused committed,
00:26:14that is, uh, uh, unlawful detention,
00:26:18abuse, and murder of hundreds of people. The fact that the court
00:26:21established this beyond a reasonable doubt, doubts, it will not
00:26:24disturb the attitudes that people in Kosovo
00:26:28have adopted on all those issues, where they see all of it in a very absolute
00:26:31way. and they reject any kind of
00:26:35fact-finding that does not correspond to their prejudices, so what
00:26:39would you say, here's another question: does this
00:26:42verdict, contextually speaking, have
00:26:45greater political, judicial,
00:26:49righteous social significance? Well, I think these things
00:26:52are not in competition, so the political significance or social
00:26:56significance of that verdict depends on what other social actors do with it.
00:26:59For example, if you were to take a verdict
00:27:03and have an educational program in schools about the facts established
00:27:06in that verdict, then that verdict
00:27:09would have social significance. If all social elites, political,
00:27:13media, educational, unite against such
00:27:16a verdict, it will be completely marginalized. I mean, that's the complete
00:27:19experience of all international courts from Nuremberg to today, yes, because
00:27:23these verdicts in any country in the region, in our
00:27:26country, in Bosnia, in Croatia, now we have
00:27:29examples in Kosovo, are actually viewed
00:27:33only through that political context, where people who are convicted in
00:27:36international or domestic courts in this case
00:27:40are essentially even more popular than they were
00:27:43before that verdict. Thaçi has more support now than when he was
00:27:47president or prime minister. So they have, meaning that glorification of the war
00:27:51criminal as actually another victim,
00:27:54so the fact that the war criminal was prosecuted
00:27:57actually makes him a victim, and no one unpacks, for example,
00:28:01what the judge read yesterday,
00:28:04what essentially happened to each individual,
00:28:08in what conditions they were, where they defecated, how they were
00:28:11beaten, what injuries they had, exactly,
00:28:15the victim herself becomes completely irrelevant, so the only thing that
00:28:18matters is the nation or the general narrative about
00:28:22the justness of the struggle. Now, let's just talk about
00:28:25the verdict itself, so we have a joint criminal
00:28:29enterprise there is no individual
00:28:32responsibility. What does that mean, does it
00:28:36even matter? So, a joint
00:28:40criminal enterprise is a form of
00:28:42responsibility where you can convict some highly
00:28:46ranked people for criminal acts that
00:28:50were directly committed by people far down
00:28:53that chain of command, meaning some ordinary guards in
00:28:57some camp, so you can convict highly ranked people
00:29:00on the basis of having actually had
00:29:04a plan, a common intention to commit certain criminal
00:29:07acts. In this particular case, the court said, Thaçi,
00:29:11Krasniqi and so on, they shared that common
00:29:14intention of abusing, arresting and killing
00:29:18political opponents of the KLA. Let's just stop here
00:29:22to make an analogy, is it similar, and it's also about
00:29:25Kosovo, as in the case of Nikola Šainović and
00:29:28Pavković, where that joint
00:29:32or common criminal enterprise was also established?
00:29:35General Lazarević, for example, was not included in that in the end, that's
00:29:39right, it's exactly the same form of responsibility. So, in that specific case before the Hague
00:29:42Tribunal, Šainović and others, which actually deals with
00:29:46the crimes of Serbian forces in Kosovo,
00:29:49uh, the Tribunal, the Hague Tribunal found that there was a treacherous criminal
00:29:53enterprise of ethnic cleansing of Kosovo
00:29:56of the Albanian population, so that was that joint criminal enterprise in
00:30:00which three of the accused
00:30:03were direct participants, the other three were accomplices. Now, when we talk about
00:30:06the length of the sentence, so we have two times 25 years
00:30:10in prison for for
00:30:12Hashim, for Hashim Thaçi and Jakup Krasniqi,
00:30:16we have 18 and 13 years
00:30:19for Kadri Veseli and Rexhep Selimi,
00:30:22uh, the debate immediately opened up whether that is a lot or a little. For
00:30:26Kosovar society, it is a lot, here the
