00:03:07sovereignty, but what does its campaign against the ICC say
00:03:11about America's commitment to international law? We ask a
00:03:15former congressman who served in the US military. I think
00:03:19me if you look at the United States of America, we have hold ourselves to very
00:03:23high standard of accountability and responsibility. Uh, I
00:03:27of don't think there are
00:03:28too many countries that would imprison.
00:03:32But is America's opposition to the ICC really about principle
00:03:36or about who the court holds to account, the war crimes prosecutor
00:03:40weighs in. It was only when a western allied
00:03:44country like Israel was targeted
00:03:47that you have this huge reprisal against the court and against
00:03:51international justice, and if the system is to survive,
00:03:55it has to be even handed.
00:03:59Hello, welcome. to the program: last month, the United States
00:04:03announced sanctions against the president
00:04:05of the international criminal court and a senior ICC
00:04:08lawyer. So far, at least 11
00:04:10of the court's officials, including the former chief prosecutor Kariem Khan and
00:04:14nine judges, have been placed under US sanctions, which
00:04:18include asset freezes and travel
00:04:20of bans. It's part of what secretary of state Marco Rubio has called a campaign to
00:04:24dismantle the ICC's threat to US sovereignty. The
00:04:28international criminal court. is an illegitimate international
00:04:32a organization, these are the people I think they can go out and basically indicate any world leader and fall them into
00:04:36the hague, so we've begun, we tried to get them to reform and
00:04:39of listen to us, they wouldn't do it, they're very
00:04:41of arrogant, we've now begun an effort to really try to bring that court to heal, by
00:04:45the way, there's no information that they're after
00:04:47of me, it could
00:04:49of happen, but just so you now, he's talking about it, I'm saying that
00:04:53means, he's not trying to
00:04:55a defend me, he is trying to defend BB and various other people,
00:04:59Rubio. also suggested the US
00:05:01of would pressure the ICC's 125 member states to
00:05:05withdraw from the court. So far, five
00:05:08of countries have begun the process of withdrawing. Niger, Burkina Faso,
00:05:12Mali. Chad and Venezuela, the renewed US pressure on the
00:05:15court started after it issued arrest warrants for Israel's prime minister Benjamin
00:05:19Netanyahu and his former defense minister over alleged war
00:05:23crimes in Gaza. The ICC is also pursuing
00:05:27investigations into U.S. personnel in Afghanistan.
00:05:30For more on the US campaign against the ICC we're joined by former Republican
00:05:34congressman Alan West. He served in Iraq and was also an
00:05:38advisor to the Afghan National Army.
00:05:42Cornel Allan West, the United States is now sanctioning top
00:05:46ICC judges, including the court's president and talking about
00:05:50dismantling the ICC. What does that say
00:05:53about the United States and its respect for international law? I
00:05:57think that what it says is there is a concern about the infringement, possibly on
00:06:01American sovereignty. I think that when you look at the ICC and its
00:06:05original mandates, I think we'd like to see more of an
00:06:08equitable decision making body as far as the
00:06:11institute. and implementation the justice and of course
00:06:15the mandates that it has across the board. how does this undermine american
00:06:19sovereignty?
00:06:20you say that the ICC is politicized, what evidence do you have to
00:06:23suggest that the the ICC is a politicized
00:06:27body? well, I tell you when you look at some the
00:06:30things that they are doing, I would love
00:06:32to see them stand up and speak out against the genocide, against the Christians
00:06:36there in Sudan. look, here in the United States of America, we uh, especially
00:06:40our 250th year of independ. uh we we're kind of
00:06:44prickly about uh our our sovereignty and uh you know
00:06:47the imposition of certain international bodies and some the
00:06:51things they may try to uh come at us against and having been a
00:06:55former member having been a former member the military we have status of
00:06:59forces agreements which hold our members the military responsible for the
00:07:03things that they do. hold on though, you said you would love to see the
00:07:06ICC investigate cases of genocide in
00:07:10Sudan. you know that it's prosecuted and it's investigated
00:07:14alleged crimes in Sudan, in fact it's arrested the former president, would
00:07:18you be equally happy to see it investigate a case of genocide in
00:07:22Palestine against Israely officials? well, first of all, let's
00:07:26understand where where the word Palestine come from? I mean, that's one the
00:07:30things we need to to get understood, and further more, when you talk about
00:07:34what's going on in Gaza, Hamas, if you read their charter, they are
00:07:37non-state, non-uniform belligerant, they call for the genocide the
00:07:41Jewish people. so again, I mean that is not with respect, this
00:07:45is not the question specifically I'm asking you whether you would equally
00:07:49love for the ICC to investigate a flagrant case of
00:07:53genocide according to most legal experts and international
00:07:56organizations committed by Israely forces in
00:08:00Palestine in Gaza. It's simple question, one the things you have to, how
00:08:04many armies in the United in the world, because the United States American
00:08:08army doesn't do this, tries to do everything possible to warn
00:08:11individuals about. coming attacks and things of this nature, so if you
00:08:15want to talk about genocide, you're talking about a country that's trying to defend
00:08:19itself, i don't think the
00:08:22israel purposefully, they're not
00:08:25purposefully targeting civilians, who isn't purposely targeting
00:08:29civilians? can you show a target list where the
00:08:33IDF is saying
00:08:34that they are purposefully targeting civilians? there are endless reports,
00:08:38independent commissions the united nations that have
00:08:40said
00:08:50Let me talk to you about the United States and its own credibility issue, the
00:08:54US is the only country in the world that has
00:08:57sanctioned ICC judges for doing their work. You
00:09:01have to take that up with the Trump administration, not with Alan West. Do you
00:09:04justify that? Uh, again, I think that you should talk to the
00:09:08Secretary of State Markal Rubio, but I'm asking about your opinion.
00:09:12is it justified that the United States
00:09:15sanction international judges for doing their work,
00:09:19whether it's in what work are they doing? that's I think
00:09:23that's the question that you should be asking Marco Rubio, not colonel Alan West sitting
00:09:27here, because I'm not making decisions that are based up about
00:09:31United States policy whatsoever in relation to ICC
00:09:34judges. The Roame Statute which established the ICC
00:09:38criminalizes retaliation against ICC officials for carrying.
00:09:42their duties, isn't this what is clearly happening here?
00:09:46again, I'm not in a position to say whether or whether not the
00:09:50United States is justified in doing that, the person that you should be
00:09:54talking to are the people that make that decision. The most important thing is to make
00:09:58sure that there's not an overstepping the ICC into the jurisdiction the
00:10:02United States of America. You served in
00:10:05Iraq, Iraq is not a state party to
00:10:09the Rome statute or the ICC, but Afghanistan is. Do you
00:10:13believe that US service members or CIA
00:10:16officers should be investigated by an independent international
00:10:20body like the ICC, if the US fails to
00:10:24prosecute. some these crimes? i think the United States does
00:10:28prosecute its own individuals and
00:10:30I think also that when the United States goes into these respective countries
00:10:34there's a status of forces agreement that is signed that makes sure that
00:10:38we abide by all the rules, the laws and the
00:10:41jurisdictions there of
00:10:43and we take care of and make sure that anybody that violates those rules and
00:10:46laws, there are people that are sitting in jail here in the United States of
00:10:50America in military prisons because they violated our code of conduct
00:10:54our... uniform code of military justice: you yourself faced
00:10:58military punishment over the treatment of an Iraqi
00:11:00detainee? military prosecutors
00:11:04found that your interrogation amounted to torture, you
00:11:08refined $500, but there are hundreds of cases
00:11:12of alleged abuse by US forces in Iraq that were
00:11:15reportedly never investigated, the vast majority did not result
00:11:19in criminal prosecutions. what should then happen when the US investigates
00:11:23itself and decides not to... prosecute, well, I think that's in
00:11:27line with the chain of command that we have here uh, in my case,
00:11:31I was uh taken out of command, I was f $5,00, I went to
00:11:34a grand jury, article 32, that's what we call it in the
00:11:38military, uh, I was uh found uh
00:11:42not not guilty of going to a court marshal, but there was
00:11:46non-judicial punishment, and I received an honorable discharge,
00:11:49but uh,
00:11:50I did uh, was held accountable for what I did, just the same was
00:11:53held accountable, you were accused of... torture,
00:11:55which is a pretty serious allegation against you, you were just flying, some
00:11:59people would say, you look, it was just psychological intimidation tactic, fired a
00:12:03pistol over guy's head and uh,
00:12:05i admitted to it, reported myself uh for that incident,
00:12:09so i don't think there was any cover up, and again coming back to what you
00:12:13talk about, what's the need the ICC to come in and what you know
00:12:17sentence me to jail, want to put me in what, international prison, no,
00:12:21but shouldn't there be proper accountability, mean what do you say to?
00:12:27these are afghans who wants more accountability for these sorts of crimes, who should have the final say? should it be the
00:12:31country accused the crime or an independent body looking into
00:12:35it? i don't think that a soldier in the United States
00:12:39army is responsible to the uh the
00:12:42international community. i think that he takes a note to the constitution the
00:12:46United States of America, he's held responsible and accountable to the
00:12:50chain of command here in the United States of America, just the same as what we saw happen with
00:12:54Nadal Hasan. and with Sergeant Hasan who uh
00:12:57killed American soldiers, there is no need for an international criminal
00:13:01court to come in and be involved in that, we can take care of that based upon our
00:13:05uniform code of military justice. Why should America be an exception though? At
00:13:09the end the day, should the United States beheld to the same
00:13:13standards that it expects other countries to follow?
00:13:17I think if you look at the United States of America, well hold ourselves to
00:13:20very high standard of accountability and responsibility.
00:13:25"I don't think there are too many countries that would imprison his own soldiers as own
00:13:29officers uh based upon the uniform code of military justice that we
00:13:33have, so I think that the United States of America does a pretty good job with this soldiers, sailors,
00:13:37airman and marines. Former congressman Alan West, thank you very

00:13:43you. The United States has had
00:13:47a contentious history with the ICC, which was established in
00:13:512002. In 2000, Bill Clinton signed..."
00:13:55the Rome statute, the treaty that established the international criminal
00:13:58court, but did not ratify it. In 2002, George
00:14:02W. Bush formally unsigned it, arguing that the ICC
00:14:06could expose American soldiers and officials to politically
00:14:09motivated prosecutions. In 2020, Donald Trump
00:14:13authorized asset freezes and other sanctions against ICC
00:14:17officials. In 2021, Joe Biden revoked
00:14:21Trump's executive order sanctioning the court in 20. 25
00:14:25Donald Trump reimpose sanctions targeting judges involved in
00:14:29investigations of US
00:14:30or Israeli nationals. So is the
00:14:33ICC a threat to US sovereignty? Reed Brody is a US
00:14:37lawyer specializing in war crimes. He helped expose the Bush
00:14:41administration's torture program in Guantanamo Bay and Abu
00:14:45Ghraib. He joins us now. Read
00:14:49Broady, the United States government says it is prepared to
00:14:52dismantle the ICC code brick by brick. Why has
00:14:56the court become such renewed target for the Trump
00:14:58administration? Well, I think there there are two
00:15:02reasons, one, this is
00:15:05insurance policy for the United States against
00:15:09accountability for crimes that the Trump administration
00:15:13is committing in plain sight. I mean, Marco
00:15:16Rubio knows perfectly well that
00:15:20bombing Iran without Security Council
00:15:23authorization. constitutes aggression under the UN
00:15:26charter, that destroying bridges, power plants, water
00:15:30treatment facilities in Iran can constitute a war
00:15:33crime, that blowing up boats in the Caribbean and killing... their
00:15:37occupants without trial constitutes
00:15:41murder, that rendering migrants to notorious salvador in
00:15:44prison where they were tortured can create criminal
00:15:48liability, um,
00:15:52and you, but I also think it has to do clearly
00:15:55with the arrest warrants against
00:15:59Benyamin Netanyahu and Joav Gallant that the
00:16:03ICC issued for alleged crimes against humanity.
00:16:07in Gaza, is this retaliation for these arrest warrants or is there more to
00:16:11it? no, I think it, I think it clearly is. I mean, these
00:16:15warrants were watershed moment in the history of
00:16:19international justice. uh, in over two decades, the
00:16:23ICC prosecutors had never sought the indictment
00:16:27of a western or a pro-western official, in fact, no
00:16:30international prosecutor going back to Norenburg had done so, for
00:16:34its first two decades, it was only African leaders in fact. That's right, it
00:16:38was for African leaders, um, and but
00:16:41you know, more generally, I mean, if you look at the
00:16:45tribunals, it was Slobdon Milosevic, Vladimir Putin,
00:16:49enemies the west, and people like me were long
00:16:52demanding um, that the ICC apply the law
00:16:55to western allies as well, and the moment it did,
00:16:59when it charged Netanyahu and Gant over Gaza, that's
00:17:03precisely when the United States moved to strangle the court, so it's
00:17:07not... being punished for its failures, it's being punished for its
00:17:11even handedness, but how much does this campaign have to
00:17:14do with the fact that Trump may very well fear that he could
00:17:18become the target of an ICC investigation in the future once he
00:17:22steps down? well, he could become a target even
00:17:25while he's even while he's the president, I
00:17:28mean bombing Iran, um,
00:17:32sending migrants to the salvador in prison, blowing up
00:17:35boats, um, even sanctioning judges and prosecutors
00:17:39for doing their job is itself a crime against the administration of
00:17:43justice under the court's own statutes and i think a way
00:17:47to look at it is
00:17:48that the Trump administration is trying to do
00:17:50abroad what they're doing at home,
00:17:54trample on international law like they're trampling on domestic
00:17:58law while they undermine all the
00:18:00institutions uh that could get in their way and as you say
00:18:04sitting presidents or prime ministers could be
00:18:08faced with an arrest warrant obviously, they could also be indicted
00:18:12by the ICC. we saw this in the case of Sudan's
00:18:15president Omar al-bashiir and others, but in the case
00:18:19of Israel, an arrest warrant with Netanyahu or even a
00:18:23prosecution against Trump, that is never likely to happen, is
00:18:27it? I mean, under the ICC statute, nobody
00:18:31has immunity, um, and the ICC has
00:18:34indicted sitting leaders, it has indicted as you
00:18:38said
00:18:39the the former president when he was the president
00:18:42of of Sudan, but it's also indicted Vladimir Putin, it's
00:18:46indicted Benjamin
00:18:48Netanyahu,
00:18:51and the problem in getting them
00:18:55before the court of course is that the ICC does not have a police force,
00:18:59so it has no act depends on state
00:19:02cooperation, so they will only get Vladimir Putin or
00:19:06Benjamin that... Yahoo uh physically before the
00:19:09ICC, if somebody hands them over, and and these people are
00:19:13careful enough not to go to places where they would be
00:19:17handed over. But the same is true for Donald Trump.
00:19:20I mean, the United States is not a party to the ICC, but if it
00:19:24commits crimes, if American officials commit crimes on
00:19:27countries that are parties to the ICC,
00:19:31um, then those states give their jurisdiction,
00:19:35and the uh, in the... same way that Russia
00:19:39is not a party to the ICC, but Putin allegedly
00:19:42committed crimes in Ukraine, which is given jurisdiction. Israel
00:19:46is not a party to the ICC, but Netanyahu has allegedly
00:19:50committed crimes in Palestine, which has given its jurisdiction. And
00:19:54here you see the flagrant hypocrisy in double standards, because when the ICC
00:19:58issues an arrest warrant against Vladimir Putin, the United States and
00:20:02its western allies all applaud and welcome the
00:20:05decision, but of course, when it involves Israel and
00:20:08Netanyahu, it's a whole different reaction, isn't it?
00:20:12That's absolutely correct. I mean,
00:20:15the the American, United States has never been a huge fan the
00:20:19ICC under any administration,
00:20:22um, but when the arrest warrant came down
00:20:26against Vladimir Putin, the Republicans, the
00:20:30Democrats, there was a motion, there was resolution in the US senate
00:20:34a hund to zero um in.
00:20:37support the ICC's arrest
00:20:40warrant for Vladimir
00:20:42Putin, and that in itself
00:20:46undermine this principle that the US had been.
00:20:50saying that, oh no, if we're not
00:20:51a stake party, you can't come after us, um, and
00:20:55so exactly the we're looking at at at
00:20:59complete double standards here, but so what is the point to the
00:21:02ICC, beyond it being a very idealistic
00:21:06institution that was set up for all the right reasons, what's the point to
00:21:10it if it is so crippled and and paralyzed by these political
00:21:14pressures? well, I think there are several
00:21:17important reasons for the ICC. first of all, it
00:21:21expresses the international
00:21:24commitment um to justice,
00:21:28um, the Rome statute, that was
00:21:31adopted 24 years ago, um,
00:21:34expresses the sentiment the international
00:21:38community, it also provides a
00:21:42protective umbrella for all these other justice
00:21:46operations to go forward around the world.
00:21:50um, in many cases that I've been involved in, the threat that
00:21:54this case could go to the ICC, or the pressure the
00:21:57ICC has has moved these cases
00:22:01along, the ICC also sets best
00:22:04practices, the ICC is in its work on sexual
00:22:08violence, and it's work on violence against children, it's in it work on
00:22:12cyber crime, has set best practices that countries around the world
00:22:16use, so it's a very important institution, but "if this
00:22:20court is destroyed now by the US and by Israel, I
00:22:24think international justice for a long time to come um is
00:22:28going to suffer. But isn't it also, isn't it also being destroyed by the
00:22:32silence of all 125 states
00:22:36parties to the ICC? Absolutely,
00:22:39absolutely. Why aren't any countries, any governments speaking up
00:22:43against these campaigns to underm,
00:22:47there are a lot of governments that have,
00:22:50particularly in particularly actually in
00:22:53Europe, um, but they're not doing it
00:22:57with the same kind of force. um,
00:23:01the European Union for instance, I mean,
00:23:05protest what Trump is doing, but it doesn't implement, for
00:23:09instance, so-called blocking legislation. I mean, let's let's first of all
00:23:13look at what the what the the US administration has already done, so
00:23:17when Trump came in back into office, he... an executive
00:23:21order saying the international criminal court represents a
00:23:24grave danger to american sovereignty, it's an emergency, and I
00:23:28authorized the use of sanctions for people who will be
00:23:32designated, and he designated the prosecutor, but then over the last
00:23:35year, Marco Rubia, the Secretary of
00:23:38State,
00:23:40has included all the prosecutors, top three prosecutors and
00:23:43eight the judges, these people have had their
00:23:47lives up ended, the administration. also named
00:23:51three Palestinian leading NGOs, Al
00:23:55Hawk, Almazm and the Palestinian Center for human
00:23:58rights, it's named the UN special rapporteur on the
00:24:02occupied territories, Francesco Albinesi, these people can no
00:24:05longer buy plane tickets, book hotel rooms, use credit
00:24:09cards, um, and now we're looking at
00:24:13potentially greater sanctions now that the court is going to be dismantled
00:24:17so-called brick by brick, but what we're not seeing. from other
00:24:21countries is economic
00:24:24protection, they could have implement blocking
00:24:28statutes that would make it illegal for
00:24:32people on their territory to abide
00:24:36and to enforce the US sanctions, mean i think
00:24:39we're seeing in this world in general the bullying
00:24:43of donald trump and too many people around the world, whether it has
00:24:47to do with the ICC, whether it has to do with.
00:24:53with the
00:24:54has to do environment or whatever, just not
00:24:57using the same vigor, to stand
00:25:00up to defend the rule of law, to stand up to defend human rights,
00:25:04to stand up to defend a world order that the United
00:25:08States helped to create, and if the system is to
00:25:11survive, it has to be even handed, and I think
00:25:15countries that believe that,
00:25:18whether they are... African countries, Latin American countries, European
00:25:22countries, Asian countries, they need to stand up for that
00:25:26independent justice or we won't have any justice. One the people trying
00:25:30implement these standards is the mayor of New
00:25:33York, Mam Dani, who had vowed to arrest
00:25:37Benjamin Netanyahu if he were to enter US territory, but is the United
00:25:41States under any legal obligation implement this arrest
00:25:45warrant? So what Mandani has quite correctly said is,
00:25:49look, New York City does not have the power to
00:25:52indict, I mean to execute the ICC
00:25:56warrant, but the government the United States certainly
00:25:59does, and
00:26:04the United States is not a party to the
00:26:06ICC um, but that
00:26:10doesn't prohibit it from executing a
00:26:14warrant, and any event, accused war
00:26:18criminal is subject to the laws the Geneva
00:26:22conventions, which say
00:26:26that you can be extra prosecuted and extradited anywhere you're
00:26:29found. the larger point that mandani. correctly makes is,
00:26:33look, we should not be rolling out the red carpet for
00:26:37this person, we should
00:26:39be describing him as a war criminal, we should not be
00:26:43inviting him to speak to a joint session of
00:26:46congress, and of course the bigger issue
00:26:50here is that the United States should not be
00:26:53complicit in Israel's
00:26:56crimes, I mean the bombs that were used
00:27:00to destroy the... schools and the hospitals
00:27:04and the homes in Gaza were American
00:27:07bombs, the Israeli campaign
00:27:10of persecution against Palestinians
00:27:14in the west bank in Gaza is carried out with
00:27:18American political, financial
00:27:22and and diplomatic support, and that's the larger question that I
00:27:25think, thanks to Mandani, we're actually talking in
00:27:29the United States about Netanyahu being..." a war
00:27:32criminal and can he be arrested rather than listening to him
00:27:36speak to joint sessions of congress. never thought i would see the
00:27:40day that a prosecutor indicted top
00:27:44Israeli official. we've seen that day. now we have to make sure that
00:27:48that becomes acceptable.

00:27:55welcome. two very different
00:27:59American perspectives on the role the ICC and the motive. behind the
00:28:03US administration's latest attack on the court,
00:28:07if the world's most powerful state support international courts only when they
00:28:10prosecute their adversaries, but threaten, sanction or bully
00:28:14them when they investigate them or their allies, then justice
00:28:18itself becomes politicized. the ICC's credibility
00:28:22and ultimately its survival will depend on whether its
