00:01:35in government has ordered an independent probe into the deaths of 37
00:01:39suspected illegal miners in NSCDC custody in
00:01:42Naggested,
00:01:44of NSCDC commandant and other offices have been suspended
00:01:48pending the
00:01:49of investigation. in The of government
00:01:49of says the probe will establish the circumstances surrounding the
00:01:53debts and determine responsibility. And of course, joining me tonight in the

00:02:08of a legal practitioner is joining us virtually, Raymond, it
00:02:12is indeed a pleasure to have you you on

00:02:30go, it's all right, let me take on you first
00:02:32of quickly, now how does a law enforcement
00:02:35of operation end with dozens of detainees
00:02:39losing their lives from your
00:02:43of standpoint? very very pointed question, honestly um, it's a very,
00:02:47very unfortunate situation, um, might call it
00:02:51case of law enforcement goon
00:02:54of totally wrong, you know, it shouldn't this sort of,
00:02:58this kind of story should never have happened.
00:03:02when the news broke, the first thing that jumped at me is
00:03:05this, under the constitution you can't detain a suspen
00:03:09beyond
00:03:10of 48 hours without charging them to the nearest court, now if these
00:03:14persons have been in custody, the question is for how long have they been kept in custody, why were
00:03:18they not ch to court, so so
00:03:20so when you prop
00:03:21in deeper into this into this issue, it does,
00:03:24of it just tells you the very very dysfunctional
00:03:27nature in which law enforcement is... conducted in this country and
00:03:31kid you not, this is my tough, the
00:03:34of NSCDC is not an isolation, it's the same thing happened across the
00:03:38various law enforcement
00:03:39you know in this in this country, and it is because this
00:03:43one has now blown in the face, that's why it is getting this of attention,
00:03:47a but I tell you this is the this is this is the norm across law various
00:03:51law enforcement you their detention cells, and I
00:03:55hope by the end of this whole incident
00:03:57of it to perhaps
00:03:58you know uh ' triggered necessary reforms to make sure
00:04:02that law enforcement agencies who have the right to detain suspect
00:04:06or detain suspect within the limitations
00:04:09of the law, if you have suspect that for some reason
00:04:13have health
00:04:15of you know underline health issues is either you you charge them to court or you send them to
00:04:19um to the nearest health facility where they could get care you
00:04:23know the fact that a person is your custody does not make
00:04:26them guilty
00:04:27of the allegations brought against them they are still retain the the
00:04:31their presumptive right of of of innocence or proving
00:04:34guilty so it's
00:04:36a very bad um situation and i just
00:04:39hope uh with the interventions here and there by the president, the police, the
00:04:43minister of interior um the those who
00:04:47are liable consequ we should see the consequences felt either in terms of
00:04:51persons losing their job so that the
00:04:53of deterrant value may be felt and we can
00:04:55you know begin to conduct law
00:04:56of enforcement with more
00:04:58of decents in this. Thank you very much, uh, Bon Ali, very
00:05:02quickly, one
00:05:04of the accounts of uh, one
00:05:06of the survivors, we were jampacked in the cell, no ventilation for
00:05:10us to breathe well, all of sudden. we realized that we could not
00:05:14breathe and we're all scampering for where to have
00:05:18fresh air. we even appealed to the several
00:05:21you know uh to them several times bank the cell door but they
00:05:25refused to answer us. this was an account from dawda
00:05:29shehu. now the NSC report, NSCDC reportedly
00:05:32attributed the death
00:05:34to suspected disease outbreak. another independent report revealed
00:05:38suffocation. is this not getting already intense with contradictory
00:05:42report? and findings: well, first of all, the constitution of this
00:05:45country, the 1999 constitution guarantees a right to
00:05:49life, you cannot take the life of any person
00:05:52intentionally a manner that is not sanctioned by law,
00:05:56eg,
00:05:57you know, execution of a court order, where someone has been pronounced
00:06:01guilty of murder and should be executed, or in defense of
00:06:04public property and lives when there's an insurgency,
00:06:08breakdown of law and order and all those things that guarantee law enforcement.
00:06:12to resist yeah a manner or when when it is a
00:06:16situation where a capital offense is being committed
00:06:20or you know and so the law enforcement have a duty to ensure that they
00:06:24prevent that capital offens in that process lives may be taken
00:06:28but these are you know places or situations
00:06:31where uh the law you know gives some kind of
00:06:35backing for that type of activity so in this situation
00:06:3933 people is huge number of Nigerians who
00:06:43should have been presumed innocent until proven guilty yeah,
00:06:46so they were a room a survivor
00:06:49says they were
00:06:52suffocated, but obviously they
00:06:55died without um um any
00:06:59legal basis for them dying in the way that they died and
00:07:03as such a probe into their deaths is the
00:07:06least that the authorities you know should ensure be
00:07:09done obviously one the you most effective
00:07:13ways of proving uh cause of death is an autopsy, the right?
00:07:17all 33 bodies
00:07:20should be uh, you should be should should be examined
00:07:23by pathologist who will determine the cause of death,
00:07:27if it is suffocation, if it is poisoning, whether
00:07:31food or drink or any form of uh, perhaps even
00:07:35gas introduced into the cell, because the subject matter the
00:07:39alleged crime is so controversial. that
00:07:43you cannot remove the fact that a crime may have been committed,
00:07:47which led to the death these 33 people, 37, 37 people,
00:07:51so it it behoves on the authorities to ensure
00:07:54that those who should be presumed innocent or to proven
00:07:57guilty, who lost their lives in the custody of constituted
00:08:01authority, there must be answer
00:08:05to how and why they died. right, Raymond, quickly,
00:08:09can an internal security agency investigation
00:08:12uncover the truth when the agency itself held
00:08:16the
00:08:17deceased,
00:08:21i don't think i don't think that should be the standard, this must
00:08:24be um any genuine investigation into
00:08:28what happened must be
00:08:30by totally independent body
00:08:34body so that is around
00:08:36of course you cannot be a judge in your own cause you cannot be
00:08:39accused. so
00:08:43investigate to what happened, so for you how to get the confidence, the public confidence in
00:08:47the outcome, you know,
00:08:48it is,
00:08:49it is,
00:08:49it is more ideal for an independent
00:08:53body to conduct and you make necessary
00:08:56recommendation. all right, quickly, uh, I
00:09:00understand that this is really getting out of hand, do you suspect any f
00:09:03play, only a proper medical
00:09:06evaluation,
00:09:07you know, a forensic pathologic
00:09:11examination will... mean the cause of death because medical
00:09:14science is uh so advanced that that is the only conclusive
00:09:18way of proving whether there was a cover, maybe you
00:09:22can allude to some form of
00:09:25high negligence, because if people are
00:09:29complaining of lack of you know uh oxygen
00:09:32or that they are being suffocated, and the people
00:09:36who are keeping them in custody are not responding, it's a high
00:09:40degree of negligence which may... rise to the point of a
00:09:44criminal uh, criminal act. now, I must take
00:09:48you up on this quickly, what immediate reforms uh, are necessary
00:09:52to ensure that enforcement operations protect
00:09:55Nigeria's mineral resources without putting the lives and
00:09:59dignity of citizens at risk? first of
00:10:03all, the resources
00:10:06the people of this country
00:10:10should be in the hands the communities.
00:10:13that have those god given resources in their
00:10:16areas, making mineral
00:10:19resources item for the exclusive legislative
00:10:23list making the federal government, the soul authority
00:10:27on the gold in my ancestral
00:10:30land, the oil at my backyard,
00:10:34the diamond
00:10:35you know under the tree in my orchard, you know smacks of
00:10:39injustice because when the resources are actually
00:10:42you know explored, the benefit to the
00:10:46people where the resources are obtained
00:10:49you know is very minimal, okay also the
00:10:53scramble in this poverty
00:10:57the indigens of area who have
00:11:00no adequate or substantial interest
00:11:03in what is within their locality leads to this kind of
00:11:07situation so that we need to move
00:11:11away from the centralized system of
00:11:14exploitation and exploration of resources and make
00:11:18those in whose backyard these resources are
00:11:21found stakeholders and beneficiaries of this.
00:11:25scramble would be less, the illegality being committed, which led
00:11:28to this deaths would be avoided. All right, and

00:11:36victory over Sunrise power and transmission company at the
00:11:39International Chamber of Commerce Arbitration Tribunal in Paris. The
00:11:43tribunal rejected Sunrise Power's claims and order the company to
00:11:47reimburs Nigeria about 11.8 million dollars in legal
00:11:51cost. The president commended Nigeria's legal team for defending.
00:11:55the country's interest uh bly quickly we
00:11:58unders with this surprise uh you know
00:12:02outcome uh the president says the ruling removes the biggest legal
00:12:06obstacle to the mambela hydroelectric power
00:12:09project uh so what happens next? what happens next
00:12:13is that this ruling clears the way for Nigeria
00:12:17to properly superintend and take care of his interest in that
00:12:21project, the legal technicalities, the contractual technical...
00:12:25by this ruling have been done away with, so the federal government can
00:12:29decide to engage another contractor,
00:12:33can can decide to be a stakeholder in contributing
00:12:36financially to the project or and not be
00:12:40burdened with the legal
00:12:43implication of deal or contract
00:12:47gone wrong, so with this ruling
00:12:50Nigeria has a free hand to move forward with
00:12:54that. All right, Raymond, quickly, I know this is your territory,
00:12:58yeah, now the tribunal rejected
00:13:02uh uh Sunrises claim for 400 million and ordered it to
00:13:06reimburse Nigeria about 11.8 million illegal
00:13:09fees. What does this tell us about uh the strength of
00:13:12Nigeria's defense before the
00:13:14ICC?
00:13:18Well,
00:13:19without a doubt,
00:13:20it speaks to um the quality of legal representation
00:13:24that this action. uh receive from the Nigerian legal
00:13:27perspective, even though I have not seen the um the
00:13:31the award, what you've heard from news report, it appears
00:13:35uh one the arbitrators even inducted the former
00:13:39minister or
00:13:41justice Malami S,
00:13:44and I think he was found to have a man of speaking played from
00:13:48both sides of the court and even even and almost even you know
00:13:52um taking sides against Nigeria.
00:13:56but to the extent that this whole process came to fion under
00:13:59the comments
00:14:03general very very very very
00:14:07distinguish,
00:14:12it's not totally surprising
00:14:14that around,
00:14:17so it's a big win for a big way for Nigeria,
00:14:20and heard my friend the studio saying per the
00:14:24government appoint another contractor, actually there is a waiting

00:14:31Chinese, the Chinese exam bank already had the financing
00:14:35to to proceed before this proceedings, stored that
00:14:38process, so with this legal out the way
00:14:41expect the the the project to come on
00:14:45full stream and it has the prospect of adding 3,896
00:14:49megaw to the national grade,
00:14:51it's a big is very very big project so consequential to Nigerias a
00:15:02how much responsibility should be attached to the officials and
00:15:06processes that allow the mambialla dispute to drag on for more than two
00:15:10decades? Unfortunately, legal
00:15:13issues, exhaust what you call the due
00:15:16process, I'm not saying that
00:15:20the length or extent to which it has dragged is
00:15:24legally justified. bible, but in ensuring that
00:15:28justice is done, all the parties that are involved in the
00:15:31dispute would have been given ample time, and technicalities
00:15:35would have been overcome to ensure. that when a final ruling
00:15:38comes uh you know it is actually final and
00:15:42there will be no recourse to any other interlocutory
00:15:46proceedings and the finality the proceedings will be guaranteed
00:15:50so I'm sure that as matter of due
00:15:53process uh evidence was received uh
00:15:57arguments were conversed uh witnesses were brought
00:16:00in uh documents were tendered and you know
00:16:04it's cross administration type of
00:16:07dispute which started with one administration, moved into another
00:16:11one and eventually into this administration, so
00:16:14cooperation of all the officials in the relevant
00:16:18ministries, including ministry of justice, those in the power
00:16:21sector, the engineers, lot went into it, I
00:16:25expect, and I'm sure that's the reason why
00:16:28you know it took a lot of time, and and I think without any
00:16:32any fear of any further
00:16:36litigation, this should be... or put an end
00:16:38to uh to to the whole saga. All right, Raymond,
00:16:42quickly, now the perhaps the biggest question now here is after winning the
00:16:46application, can the federal government turn the mambialla
00:16:49victory into actual electricity for Nigerians from your
00:16:53standpoint? Yeah, absolutely, and like I was saying
00:16:57before I had the audio issues, I had
00:16:59said, the before this matter went for arbitration
00:17:03effectively, the the contract had been awarded to different
00:17:06Chinese. company and in fact the chinese
00:17:10export import bank had a 85%
00:17:14financing on the project, but due to this dispute, they could not
00:17:18proceed pending the outcome, so with this litigation out the
00:17:22way, what is expected is that the necessary financing from
00:17:26the Chinese exam bank will
00:17:27be brought to bear, the project had the prospect of adding
00:17:313,896 megw to the national grade, so it is
00:17:35very, very consequential to Nigeria's economy. and we hope
00:17:39that in the weeks and months and years ahead the project will come on
00:17:42stream and the prospects the the
00:17:46mandilla hydropilot project will come to fusion. all right, thank you very much. well let's

00:18:50watched the press conference by the progressive governors forum, I
00:18:54could not understand what the force is about, if anything, I would
00:18:57think this is even a good problem to have, you know, at
00:19:01the end the day, both sides are working towards a common end, which
00:19:05is uh, delivering or... returning or reelecting
00:19:09president so uh Mr. Wike has never
00:19:12been,
00:19:13he has not, he has never means what about his support for
00:19:17president,
00:19:18you know, so if he's not if he's not if if his rainbow
00:19:21coalition is not trying to support different
00:19:25presidential candidate, I don't know why the progressive governors
00:19:28governors
00:19:29are are jittering, I think they should consolidate forces and
00:19:33you work towards what is clearly.

00:23:03les the coalition or any other person who Mr. Wink is able to
00:23:07governize towards delivering Mr. President at, so
00:23:21could this dispute become a bigger problem for the APC if
00:23:24politicians begin supporting to
00:23:26at the presidential level, but back in different parties below the
00:23:30presidential ballot? it could be a problem, okay, it could be
00:23:33very, very serious problem, but I don't see the
00:23:37problem being allowed to fester for too long, long, okay, I
00:23:41think that once the the mandate the president is
00:23:45secured, the necessary adjustment and
00:23:48amendments to... will campaign structure will
00:23:51follow, and so
00:23:53that will mitigate any tendency for any harm
00:23:56coming to the other elections. All right, Raymond, I'm not trying to put you on the sport
00:24:00here, but uh, your final take on this, is the rainbow coalision
00:24:04becoming an alternative political structure, or is it
00:24:07simply a network of politicians united by
00:24:11support for president Bolatinoubu? You could have
00:24:15put it any better, absolutely the latter,
00:24:18absolutely. self life is by
00:24:22the e by the by the by by the end the presidential election is
00:24:25chef life will come to an
00:24:26end
00:24:31all right then it appears we just have to go but bola before i go
00:24:35quickly um it's looking quite dicey from your point
00:24:39of view with way you have actually assessed the situation that there's a possibility that
00:24:43the APC governors have certain fears because is it that the
00:24:46stature the personality of wiki is? problem
00:24:50now or the party itself that he's forming,
00:24:54the coalition that he's coming up with, is it the coalition or the
00:24:58personality is that they have a problem with? the suspicion of his real
00:25:02intention is the problem, i think that he is a
00:25:05consumate politician and understands the game, understands the
00:25:09game and has been effective in working for the
00:25:12president's mandate and delivering
